1.

In the matter of extending the contract for Janitorial Services, Glen Gregory, Maintenance

                                     

Background: The contract for Janitorial Services was set to expire on December 31, 2022.  The Board of Commissioners approved a six month extension of time with our current provider, Detailing Specialists, Inc., to allow time to negotiate a new contract for janitorial services with the Oregon Forward Program. 

Recommended Motion: The Board of County Commissioners approved the six month extension to the contract for Janitorial Services during the public Work Session on December 21, 2022.   Fiscal impact: $19, 940.00 per month from the Maintenance Facility Services Fund.

Bids/Awards/Proposals

1.

In the matter of accepting the quote from Frontier Precision for the purchase of Survey Equipment. Jeremy Morris, Public Works

Background:  Klamath County Public Works would like to utilize Klamath County’s membership in the ORCPP program to purchase a Trimble R12 GNSS System and various related Survey equipment off of DES Contract #02918.  Members of the Oregon Cooperative Procurement Program are eligible to use Washington State Master Contracts.  The proposed system will expand Public Work’s abilities for efficient inventory data collection for asset management, as well as provide for survey equipment redundancy, which will reduce any loss of productivity in the event of equipment failure.

Recommended Motion:  Board to accept the quote from Frontier Precision for the purchase of Survey Equipment and authorize Public Works to issue a Purchase Order.  Fiscal Impact: $23,333.35 expenditure to the Road Department Operating Budget.

Budget Resolutions

1.

In the Matter of the Adoption of a Budget Resolution with the Solid Waste Equipment Reserve Fund and Public Works Operating fund. Vickie Noel - Finance

Background: The following budget change to the 2022-23 budget is being proposed for approval:

Solid Waste Reserve – The Division took advantage of purchasing a used pumper truck from the Public Works Division. The funds for the truck will be transferred from the vehicle other line item to a transfer to Public Works line item.  

Recommended Motion: Approve the budget resolution for fiscal year 2022-23 as outlined in the attached documents within the Solid Waste Equip Reserve Fund and Public Works Operating fund. There is no fiscal impact to the Solid Waste Equipment Reserve, there is a $60,000 increase in revenues and expenditures to the Public Works Operating budget.

1.

In the Matter of approving a Resolution designating Commissioner liaison responsibilities for the period January 3, 2023 through December 31, 2023. - BOCC

Background:  The Board of Commissioners has determined that assigning liaison responsibilities is an effective way in which to achieve maximum communication and information sharing between County departments and the Board of Commissioners.

Fiscal Impact: None.

Recommended Motion:  Approve and sign the attached Resolution designating Commissioner liaison responsibilities for the period January 3, 2023 through December 31, 2023.

1.

In the matter of appointing Jennifer Fairfield, Joe Young, Ryan McNiven and Randy Shaw to the Planning Commission. - BOCC

Background: The Planning Commission has 4 vacancies; 5 applications were received. After interviews and consideration from the Board of Commissioners it was decided to appoint Jennifer Fairfield, Joe Young, Ryan McNiven and Randy Shaw.

Recommended Motion: Approve and sign the attached Order appointing Jennifer Fairfield, Joe Young, Ryan McNiven and Randy Shaw to the Planning Commission.  There is no Fiscal Impact.


2.

In the matter of appointing Gregg Sherrill, Amy King and Edith Brown-Vieyra to the Fair Board. - BOCC

Background: The Fair Board has vacancies. Gregg Sherrill, Amy King and Edith Brown-Vieyra applied to fill said vacancies and are willing able and eligible to do so. 

Recommended Motion: Approve and sign the attached Order appointing Gregg Sherrill, Amy King and Edith Brown-Vieyra to the Fair Board.  There is no Fiscal Impact.


3.

In the matter of executing an order for the designation of a portion of Dodds Hollow Road as a Class “E” County Road for maintenance clarification. Jeremy Morris, Public Works

Background:  Portions of Dodds Hollow Road has been maintained as a limited maintenance gravel road standard and a user maintained public road standard for many years.  This Order clarifies the location and the level of performed maintenance, and designates it as a Class “E” County Road. 

Recommended Motion:  Board approve and execute the order to designate a portion of Dodds Hollow Road as a Class “E” County Road for maintenance clarification.  Fiscal Impact is none.

4.

5.

In the matter of appointing Karen Williams to the Rainbow Park Pine Ridge Special Road District Board. - BOCC

Background: The Rainbow Park Pine Ridge Special Road District Board has a vacancy and has recommended the above named applicant who is willing, able and eligible to serve a term on the Board commencing January 1, 2023 and expiring December 31, 2025.

Recommended Motion: Approve and sign the attached Order appointing Karen Williams to the Rainbow Park Pine Ridge Estates Special Road District Board. There is no Fiscal Impact.

6.

In the matter of vacating Lots 2 and 3 Block 7 of Sprague River Pines Tract 1029. Map No. R-3408-022C0 Tax Lots: 04900 and 05000. CDD / Planning - Erik Nobel

Background:  The property owner of the two lots is Janine L. Scott of Janine L. Scott Living Trust who has signed a petition requesting this action.  Vacating the lots will not be detrimental to the public.  The Planning Director’s Report recommends that the two lots be vacated from the subdivision. The applicant paid the $600 application fee to process the request to vacate the lots.  Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

 Recommended Motion:   Approve the Final Order to vacate the above described property located in Klamath County Oregon. (File No. LV 13-22).  There is no fiscal impact to Klamath County. 

 Fiscal Impact:   There is no fiscal impact to Klamath County.

7.

In the matter of vacating Lots 1 and 2 of Pleasant Homes Tracts No. 2. Map No. R-3909-002AD Tax Lots: 09100 and 09200. CDD / Planning; Erik Nobel

Background:  The property owner of the two lots is Klamath Falls Sonic LLC who has signed a petition requesting this action.  Vacating the lots will not be detrimental to the public.  The Planning Director’s Report recommends that the two lots be vacated from the subdivision. The applicant paid the $600 application fee to process the request to vacate the lots.  Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

 Recommended Motion:   Approve the Final Order to vacate the above described property located in Klamath County Oregon. (File No. LV 14-22).  There is no fiscal impact to Klamath County.

12.

Agreements

1.

In the matter of signing the Amendment No. 1 to Memorandum of Understanding between Klamath County, Oregon and the Klamath River Renewal Corporation. CDD / Planning - Erik Nobel

Background:  On March 26, 2019 Klamath County and the Klamath River Renewal Corporation (KRRC) agreed to a Memorandum of Understanding (MOU) regarding the removal of the John C Boyle Dam.  The MOU covers traffic management and land use consistency.  

On July 15, 2022, the consultant team for KRRC reached out to discuss the project and review the MOU.  Upon review of the MOU there were some changes needed to the language to provide clarity.  The changes help to emphasize the County expectation that all county roads will be left in the same or better condition than the roads were at the start of the project.   The amendment also addresses the ability to place job trailer on site during the demolition activities.    

 Recommended Motion:   Approval to the sign the Amendment No. 1 to Memorandum of Understanding between Klamath County, Oregon and the    Klamath River Renewal Corporation.  

 Fiscal Impact:   There is no fiscal impact to Klamath County.

In the matter of approving and authorizing the chair to sign the Oregon Water Resources Department - Klamath County Domestic and Community Well Assistance Grant Agreement - Vickie Noel, Finance Director

Background: The purpose of the Klamath County Domestic and Community Well Assistance Grant is to address impaired domestic and community wells. Grant funds will be used to repair, replace, deepen, and abandon domestic and community wells impacted by drought. The grant funds may also be used for planning, development, and construction of a public water filling station to serve those whose wells cannot meet their domestic water needs; administrative costs related to managing the emergency water delivery program in place to serve those whose wells cannot meet their domestic water needs; and costs associated with development of a well drilling program to address the lack of well drilling professions. 

Recommended Motion: Approve and authorize the chair to sign for $5,000,000.00 Oregon Water Resources Department – Klamath County Domestic and Community Well Assistance Grant. Fiscal Impact: $5,000,000.00 to the Commissioners Miscellaneous Grant Fund.

3.

In the matter of approving and authorizing the chair to sign the cooperative agreement with USDA for APHIS Wildlife Services - Vickie Noel, Finance Director

Background: The purpose of the Wolf Depredation Compensation and Financial Assistance Agreement is to assist the County in supporting the implementation of non-lethal wolf damage management techniques and strategies by livestock producers in areas where wolf depredation of livestock is on-going and to provide compensation for injury or death to livestock resulting from wolf depredation.

Recommended Motion: Approve and authorize the chair to sign the US Department of Agriculture for USDA APHIS Wildlife Services. Fiscal impact: $12,057.55 expenditure from the Wolf Depredation Grant.

4.

In the matter of approving Amendment #1 to Intergovernmental Agreement (IGA) #55204 between Lane County and Klamath County. – Jennifer Little, Public Health

Background:  Under agreement #55204, which became effective January 1 2020, Lane County provides and maintains on-line food handler card training and testing services accessible by Klamath County residents. Each food handler test costs $10. Under the terms of the agreement Lane County retains between $2 and $5 of that amount to cover administration as outlined in the scope of agreement. The remainder of funds generated from online testing come to Klamath County Public Health (KCPH). The amendment adds anticipated revenue sharing in the amount of $32,000 for the period of extension from January 1, 2023 to December 31, 2024. 

Recommended Motion:  Move to approve Amendment #1 Intergovernmental Agreement (IGA) #55204 between Lane County and Klamath County. Fiscal impact is estimated revenue of $12,800 per year for a total of $25,600 for the period of extension from January 1, 2023 to December 31, 2024.  Authorize department head to sign. 


5.

In the matter of approving the agreement for the Spanish Radio and Multimedia Project between Wynne Broadcasting and Klamath County Public Health (KCPH). –Jennifer Little, Public Health

Background:  In an effort to enhance its communication capabilities with the Spanish speaking community, Klamath County Public Health would like to fund a multimedia project that includes a streaming radio station, website, and social media. This project is in collaboration with local stakeholders, and will benefit the County and its partners by opening new, targeted channels of communication. Additionally, this project aligns with Public Health’s Modernization work and meeting foundational capabilities. On October 27, 2022 KCPH issued a request for quotes and received only one response from Wynne Broadcasting. After reviewing the proposal, it was determined they met all of the criteria. In addition, the proposal was reviewed by the Hispanic Health Committee leadership and they too supported it. 


Recommended Motion:  Move to approve the agreement for the Spanish Radio and Multimedia Project between Wynne Broadcasting and Public Health. Fiscal impact is expense of $134,800 for the first year of the agreement to cover development, implementation, and maintenance of the project. Subsequent years would have an annual cost of $117,600. Expenses will be paid out of Public Health Modernization funding, sub department 4039.  Authorize department head to sign.


6.

In the matter of requesting Klamath County Board of Commissioners approval to enter into Agreement No. 250-2123KLAMATH-000 4th Amendment Adjusting proposed program costs -Chris Kaber, Sheriff

Background: The Sheriff is requesting approval to enter into Intergovernmental Agreement No. 250-2123KLAMATH-000 Amendment 4 with the Oregon State Marine Board (OSMB) which will amend an oversight of omitting the previously agreed upon boat build that should have been included in Amendment #3 Revenues.  Amendment 3 adjusted revenues for Sheriff’s Office reduction of time dedicated to the contract.

Recommended Motion:  Approve and authorize the Sheriff to sign Intergovernmental Agreement No. 250-2123KLAMATH-000 Amendment 4 between the Klamath County Sheriff’s Office and the Oregon State Marine Board which increases revenues in the amount of $104,990 for the 2022-2023 fiscal year due to boat build agreement. Fiscal Impact: No Fiscal impact in Klamath County Sheriff’s Office – Marine revenue since the boat build was accounted for in budget.

7.

In the Matter of approving the Sheriff to enter into grant agreement 22-280 with State of Oregon Department of Emergency Management. Brandon Fowler, Emergency Management

Background: This agreement with the Department of Emergency Management provides funding for the Emergency Management Division in the 2022/2023 budget year under the State Homeland Security Program. This grant is a yearly allocation that we're awarded.

Recommended Motion:  To approve and authorize the Sheriff to sign grant agreement 22-280 with the State of Oregon Department of Emergency Management.  Fiscal Impact: Grant revenue of $44,137.03 to the General Fund Sheriff’s Office Emergency Management.

In the Matter of approving the Sheriff to enter into grant agreement 22-517 with State of Oregon Department of Emergency Management. Brandon Fowler, Emergency Management

Background: This agreement with the Department of Emergency Management provides funding for the Emergency Management Division in the 2022/2023 budget year under the Emergency Management Performance Grant. This grant is a yearly allocation that we're awarded.

Recommended Motion:  To approve and authorize the Sheriff to sign grant agreement 22-517 with the State of Oregon Department of Emergency Management.  Fiscal Impact: Grant revenue of $79,545.00 to the General Fund Sheriff’s Office Emergency Management with a county matching funds of $79,545.00.

9.

In the Matter of approving an agreement with InfoTech for a term of 1 year for Information Technology Research & Advisory Subscription Services - Jessica Chastain, IT

Background: The Klamath County IT Department has various projects that we are engaged in and contracts that we are currently renegotiating.  InfoTech provides services that help with assisting in research in various IT driven services, content libraries, and assisting with right sizing IT contracts.   Klamath County IT feels that this investment would assist in right sizing some multiyear, complex contracts that are worth over $100,000 and would provide better baselines for going forward.   Also, the department is in the process of redesigning various policies, procedures, and plans that InfoTech specializes in assisting with.  InfoTech has an agreement with the Oregon Buys Purchasing Program, Master Price and Services Agreement, agreement number 8347, along with Gartner and IDC.  The pricing per year for the three providers on the Oregon Buys Purchasing Program is below:

Recommended Motion:  Approve the agreement with InfoTech with a fiscal impact of $14,453 for a year, from the Technology Maintenance budget, authorizing the IT Director to sign.

10.

Approving an Oregon Lottery Grant Agreement for the Klamath County Juvenile Department Klamath Crimson Rose (KCR) Construction Project.-Dan Golden, Director

Background:  In 2017 and 2021, the Oregon Legislature approved Lottery grants totaling $13 million to fund the construction of the KCR residential treatment facility at the Juvenile Department. $12 million will become available in 2023 after a state bond sale. In 2022, Klamath County approved a $1 million match. The project is underway. The Oregon Department of Administrative Services (DAS) has issued a grant agreement to Klamath County for the $12 million Lottery Grant approved by the legislature in 2021. The Juvenile Department requests the BOCC approve the Oregon Lottery grant for $12 million and approve Commissioner Kelley Minty to sign the agreement.

 

Recommended Motion: The Board of County Commissioners of Klamath County approves the agreement for an Oregon Lottery grant, the State of Oregon Lottery Revenue Bonds Grant Agreement, for $12 million in additional revenue for the KCR Construction Project. The BOCC approves Commissioner Kelley Minty to sign the agreement. The fiscal impact is $12 million in revenue to the KCR Construction Project.

Other County Business

1.

In the matter of authorizing the signing of a Land Partition Plat for the dedication of right of way. Land Partition 4-21 CDD / Planning Erik Nobel

Background:  The property owner, Wood River Ranch LLC , applied for a Land Partition on a property located in Fort Klamath (Tax Lot 3307-V0000-02300).  

 The Main Street Right of Way is currently 30 feet wide.  The current standard width for a local street right of way is 60 feet. A condition was placed on the approval of the Land Partition for the dedication of 30 feet additional right of way for Main Street making the Main Street Right of Way 60 feet in width.   The applicant complied with this condition and drafted the Land Partition Plat dedicating 30 feet of addition right of way.  The Final Plat has been reviewed and approved by the Klamath County Surveyor, Public Works and Planning. 

Dedication of right of way requires acceptance by the County Commissioners, and the signature of the Commissioners on the Plat.   

 Recommended Motion:   A motion to approve the signing of Land Partition 4-21 Plat accepting the 30 foot of addition right of way.  

 Fiscal Impact:   There is no fiscal impact to Klamath County.
