In the Matter of Proclaiming March and April 2023 as Substance Abuse Awareness Months in Klamath County, Oregon. - BOCC

Background:  Read proclamation.

Recommended Motion:  None.   There is no fiscal impact.

Bids/Awards/Proposals

1.

In the matter of accepting a quote and authorizing the purchase of exterior food court lighting for the Klamath County Event Center, Derrick Rowley, Director

Background: Derrick Rowley, Director of the Klamath County Event Center/Fairgrounds requested quotes for electrical/lighting upgrade and installation for continuation of the Food Court Expansion Project. Three responses were received with Pacific Electrical Contractors coming in with the winning bid at $19,880.00. 

Recommended Motion:  To approve the Klamath County Fairgrounds/Event Center Director, Derrick Rowley, to sign and accept the quote of $19,880.00 from Pacific Electrical Contractors. The fiscal impact is $19,880.00. The expenditure will be paid with ARPA Grant Funding dollars.

 

2.

In the matter of Board approval of the purchase of replacement carpet from Mannington Mills Inc using Soucewell Cooperative purchasing agreement 080819-MMI,through Cardinal Flooring. Glen Gregory, Maintenance

Background: Klamath County Maintenance is seeking to purchase Carpet from Mannington Mills Inc. to be used in the replacement of the current carpet at the Klamath County Government Center. This quote in the amount of $33,937.68, was obtained using the Soucewell Cooperative purchasing agreement 080819-MMI, through Cardinal Flooring.

Recommended Motion: Board approval of the purchase of replacement carpet from Mannington Mills Inc, through Cardinal Flooring, using Soucewell Cooperative purchasing agreement 080819-MMI. Fiscal Impact; $33,937.68 to paid from the Facilities Improvement.

In the Matter of accepting the quote for a fire alarm panel upgrade for the Klamath County Courthouse from Secure Com (a proprietary vendor). Glen Gregory, Maintenance

Background: The fire alarm panel at the Klamath County Courthouse is failing and an upgrade is needed.  Secure Com is the only vendor that can provide the necessary upgrade.  Secure Com provided a quote for the upgrade in the amount of $11,556.  Maintenance received verbal quotes to replace the system from PEC and Bel Tel both of which were in the amount of $90,000-$100,000.

Recommended Motion:  Board approval of the quote for the purchase of the fire alarm panel upgrade from Secure Com.  Fiscal Impact:  $11,556 to be paid from the Facilities Improvement fund and authorize the department head to sign.

In the matter or requesting approval of the purchase of a 2018 Ford Explorer for the Jail Commander to replace a 2009 Ford Explorer that was wrecked and considered a total loss - Chris Kaber, Sheriff

Background: The purchase from Lithia Toyota of Klamath falls of a 2018 Ford Explorer for the Jail Commander to replace the previous 2009 Ford Explorer that was totaled on November 11, 2022. The purchase of the vehicle has a total expense of $19,980.00 plus taxes and fees in the amount of $20,462.42. 

The funds used to purchase this vehicle will be the $8,333.00 insurance pay out check and $12,129.42 from the Sheriff’s Office - Corrections Equipment Reserve. This purchase is due to unforeseen circumstances and is not part of the 2022-23 budget. A budget resolution might be necessary.

Recommended Motion: Approve the Klamath County Sheriff’s Office to accept the quote and to sign for the purchase of one 2018 Ford Explorer from Lithia Toyota of Klamath Falls. Expenditures in the amount of $20,462.42 to be paid from the Sheriff’s Office – Correction Equipment Reserve and insurance pay out.

1.

In the matter of appointing Charles Gray to the Roads Advisory Committee. - BOCC

Background: The Roads Advisory Committee has a vacancy and has recommended Charles Gray who is willing, able and eligible to serve a term on the Board commencing this day and expiring December 31, 2026.

Recommended Motion: Approve and sign the attached Order appointing Charles Gray to the Roads Advisory Committee. There is no Fiscal Impact.


9.

Agreements

1.

In the matter of a Memorandum of Understanding between the Klamath County Surveyor and the Klamath County Assessor for GIS Survey Index maintenance. Sheryl Hatcher, Surveyor

Background: This Memorandum of Understanding allows the Klamath County GIS Office to provide GIS services to maintain the GIS Survey Index.  Maintenance to be performed in a timely manner includes adding all new Surveyor’s Office plat and survey filings.  The monthly invoices from the GIS Office will be paid out of the Surveyor ARP Fund.

Recommended Motion:  Board to approve the Memorandum of Understanding between the Klamath County Surveyor and the Klamath County Assessor for GIS Survey Index maintenance, and authorize the Surveyor and Assessor to sign.  This agreement will be effective for fiscal years 2024 through 2026.  Fiscal Impact will be $10,000.00 per year expense from the Surveyor ARP Fund and income of $10,000.00 per year to the GIS Operating Budget.

2.

In the matter of an agreement between Klamath County and Running Y Ranch Management, LLC for noxious weed control. Jeremy Morris, Public Works

Background: Klamath County enters into agreements with outside agencies to treat noxious weed infestations on their property.  The purpose of this agreement is to control the growth and spread of noxious and non-native weeds at Running Y Ranch Resort – road right-of-ways and specified common areas.

Recommended Motion:  Board approve and sign the agreement between Running Y Ranch Management, LLC and Klamath County for noxious weed control.  Fiscal Impact is $2,000.00 income to the Weed Control Budget.

3.

In the matter of approving Amendment #12 to Intergovernmental Agreement (IGA) #169517 for the Financing of Public Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). -Jennifer Little, Public Health

Background: Agreement #169517, which became effective July 1, 2021, delegates authority to Klamath County Public Health to operate public health programs in Klamath County. This amendment replaces program element (PE) descriptions for PEl0 "Sexually Transmitted Diseases (STD) Client Services", PE43 "Immunization Services" and PE 51 "Public Health Modernization". In addition, Attachment B, the Financial Assistance Award for fiscal year 2023 is updated by this amendment. The agreement remains effective through June 30, 2023. 

Recommended Motion: Move to approve Amendment #12 to Intergovernmental Agreement (IGA) #169517 for the Financing of Public Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). Fiscal impact is increased grant award for FY 23 of $6,255 to sub department 4029 for Public Health Emergency Preparedness, $12,807.43 to sub department 4041 for Safe Drinking Water and $64,998 to sub department 4049 for Overdose Prevention. Authorize the Department Head to sign. 

4.

In the matter of approving the room reservation application for a room at Klamath Community College–Jennifer Little, Public Health

Background:  Klamath County Public Health would like to use a classroom at KCC to host a teen leader training. The room reservation would be for April 12, 2023 from 7:30am to 6:00pm.  

Recommended Motion:  Move to approve the application for Public Health to use a classroom at Klamath Community College. Fiscal impact is $135 from Health Promotion Disease Prevention sub department 4049.  Authorize department head to sign.

5.

In the matter of approving and signing Klamath County American Rescue Act grant agreements for the completed and ready applicants – Natalie Parker, Grant Manager

Background: The American Rescue Plan Act Grant Allocation Committee met on January 18, 2023 to hear presentations from eligible grant applications to the Board of County Commissioners (BOCC) for funding. The ARPA Grant Allocation Committee reviewed the recommendations and approved funding to grant recipients on January 19, 2023 for the applicants as detailed below:

          SMART Reading        $ 50,000

          WOODSY KITCHEN $105,000

All grant submission requirements have been satisfied and the contract is complete and signed by grantee.

Recommended Motion: Approve and sign the Klamath County American Rescue Plan Act Grant agreement. Fiscal impact of $155,000.00 expenditure from the COVID19 Pandemic Grant fund. Fiscal Impact: Expenditure of $155,000.00 from the COVID19 Pandemic Grant fund.

6.

In the matter of granting access to APHIS trapper, Rick Vaughn Tax/Property Management

Background: Klamath County wishes to enter into an access agreement with Andy Cleland, trapper for United States Department of Agriculture Animal and Plant Health Inspection Service (APHIS) Wildlife Services for abatement of problem animals due to damage complaints on Klamath County owned properties.


Recommended Motion:  Grant access to Klamath County owned properties to APHIS trapper for abatement of problem animals and authorize Rick Vaughn, Klamath County Property manager, to sign agreement.  No Fiscal impact. 


7.

In the matter of requesting approval to enter into and sign Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #005 with the U.S. Forest Service (USFS) - Chris Kaber, Sheriff

Background: The modification is the 2023 Annual Operating Plan (AOP) which will be attached as Exhibit A to the Cooperative Law Enforcement Agreement. It dedicates funding for law enforcement patrol services on US Forest Service land in the amount of $30,800 and $40,000 for Operation Forest Watch for the 2023 calendar year. The funding is provided on a reimbursement basis based on hours of service provided. The AOP also updates the current reimbursable rates.

 Recommended Motion:  To enter into and approve to sign the Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #005 with the U.S. Forest Service. Fiscal impact is potential revenues of $70,800 into the General Fund-Sheriff’s Office-Patrol Division in the 2023 calendar year. 

8.

In the Matter of requesting the Board for approval for the DDS office to participate in the Basin Partners Internship Program (BPIP). Myles Maxey, DDS

Background: DDS will host two Klamath County BPIP students, for 4-5 weeks during summer break 2023 per the Host Expectations agreement. In summary, BPIP and DDS agree to cooperate in providing a career-based learning experience for high school trainees that supports a variety of perspectives on work in the host organization’s field of expertise.

Recommended Motion:  Approve the agreement with Basin Partners Internship Program for Developmental Disabilities Services and authorize Myles Maxey, Director to sign the BPIP Host Organization Expectations Agreement.  Fiscal Impact: The cost is a $2,400.00 expenditure. The expenditure will be paid out of the Developmental Disabilities Services materials and services budget.

Other County Business

1.

In the matter of approving Klamath County’s Juvenile Crime Prevention (JCP) Plan for the 2023-25 biennium. -Dan Golden, Juvenile

Background: The Oregon Department of Education (ODE) has taken over responsibility for funding juvenile crime prevention programs formerly funded by the Commission on Children and Families. Klamath County receives youth development funds to support programs for juvenile crime prevention. The designated agency to evaluate programs and administer funds is the Klamath County Juvenile Department. The JCP Plan will fund three continuing programs of Lutheran Community Services, Klamath Tribal Court, and Citizens for Safe Schools for the 2023-2025 biennium. On March 1, 2023, the Klamath County Local Public Safety Coordinating Council (LPSCC) approved the JCP Plan. ORS 423.565 provides for LPSCC to recommend the JCP Plan to the BOCC.       

Recommended Motion:  Approve the Klamath County Juvenile Crime Prevention (JCP) Plan for the 2023-2025 biennium. Fiscal Impact: ODE will award funds to Klamath County for the 2023-25 biennium. The amount will be determined by the legislature. Klamath County is receiving $94,426 in the current biennium.
