Background: The Sheriff’s Department has received various donations from the Klamath Dog Fanciers and many other generous citizens which has enabled us to request the purchase and training of a canine. We are requesting approval to purchase a canine from Top Dog Police K9 Training & Consulting, LLC. The cost to purchase and train the canine and provide on-site training to the deputy handler is quoted at $10,500.
Recommended Motion: Approve the Klamath County Sheriff’s Office to accept the quote and to purchase a canine from Top Dog Police K9 Training & Consulting, LLC for the amount of $10,500.00 which includes initial on-site training of the canine and the deputy handler. Fiscal Impact: Expense of $10,500.00 to be paid from the Sheriff’s Office Special Revenue Fund.
Background: Code Enforcement (CE) had teamed with the Klamath County Sheriff’s office to acquire four 4-door pickups from Emergency Responder Services in early 2022 with no delivery in site. Recommended Motion: Approve acceptance of quote for two 2023 Ford Pickups from Lithia Ford of Klamath Falls and authorize Rick Vaughn, Code Enforcement Mgr, to sign for vehicles. Fiscal Impact is an expenditure from the Marijuana Eradication Grant fund in the amount of $97,714 + DMV, Taxes and fees.
Background: Code Enforcement (CE) had teamed with the Klamath County Sheriff’s office to acquire four 4-door pickups from Emergency Responder Services in early 2022 with no delivery in site. Since that time, CE has had one vehicle starting to experience major problems and have borrowed another from the Assessors office. Lithia Ford has quoted 2 vehicles in stock for $100,093.71 that match the specifications desired. Butler Ford has two similar pickups quoted at $108,220.92. CE has these funds budgeted from ARPA funds and vehicle reserve.
Recommended Motion: Approve acceptance of quote for two 2023 Ford Pickups from Lithia Ford of Klamath Falls and authorize Rick Vaughn, Code Enforcement Mgr, to sign for vehicles. Fiscal Impact is an expenditure of $90,000 from the Code Enforcement ARPA and $10,093.71 from the Code Enforcement Equipment reserve fund.
Background: Chapter 279 of the Oregon Revised Statutes (ORS) establishes rule and authority pertaining to the procurement of goods and services by public agencies and provides for public contracting agencies to adopt their own rules of procedure for public contracting. Klamath County has contracting policies and procedures in place that incorporate both the Attorney General's Model rules (Oregon Administrative Rules, Chapter 137) and the rules developed by the Department of Administrative Services (Oregon Administrative Rules, Chapter 125). A public contracting agency must review their contracting rules each time the Attorney General adopts a modification of the model rules to ensure compliance with statutory changes pursuant to ORS 279.A065(6)(b). The Revised Klamath County, Oregon Contracting Policies and Procedures have been reviewed and updated by the Contract & Risk Manager and Klamath County Counsel. The revisions to the Klamath County Contracting Policies and Procedures Chapter 1 section 1.15 (1), County Procedure Prior to Contract Award, clarifying all MOU’s, MOA’s, IGA’s and Letters of Agreement (LOA) will require Board approval through a regular Business meeting and Chapter 3 section 3.15, Selection for Architect or Engineering Services, will align appointment procedures for specified services with OAR’s 137-048-0200 through 137-048-0220. Chapter 3 revisions were discussed during the January 3, 2023 Administrative Meeting.
Recommended Motion: That the Klamath County Board of Commissioners approve and sign the attached Resolution that adopts the revisions to the Klamath County Contracting Policies and Procedures Chapter 1 section 1.15 (1)(b), and Chapter 3.15 Selection for Architect or Engineering Services as discussed above. Background: The Domestic Well Grant Review Panel met on May 5, 2022 to review and recommend grant applications to the Board of County Commissioners (BOCC) for funding. The BOCC reviewed the recommendations and approved funding to grant recipients during the Admin meeting on June 7, 2022. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

Background: The American Rescue Plan Act Grant Allocation Committee met on January 18, 2023 to hear presentations from eligible grant applications to the Board of County Commissioners (BOCC) for funding. The ARPA Grant Allocation Committee reviewed the recommendations and approved funding to grant recipients on January 19, 2023 for the applicants as detailed below:

Recommended Motion: Approve and sign the Klamath County American Rescue Plan Act Grant agreement. Fiscal impact of $145,000.00 expenditure from the COVID19 Pandemic Grant fund. Fiscal Impact: Expenditure of $145,000.00 from the COVID19 Pandemic Grant fund.
Background: The Klamath County Fairgrounds/Event Center is in the process of expanding the east RV area and a design/build contract to construct 48 full-service sites. The Fair Board and management were presented with the ARPA grant opportunity issued from SCOEDD as a pass-through grant from Oregon DAS, to assist in this project.
Recommended Motion: Approve and authorize the BOCC Chair to sign the American Rescue Plan Act IGA between the Klamath County Fairgrounds/Event Center and South-Central Oregon Economic Development District; and authorize the Klamath County Board of Commissioners Chair to sign the agreement; and authorize Derrick Rowley, Director/Manager to accept the funds into the Fair Board operating budget. Fiscal Impact: $225,000.00.
Background: The City of Klamath Falls is putting in a Pump track at Eulalona Park. DDS would like to contribute $50,000 to promote accessible opportunities for individuals experiencing intellectual and developmental disabilities within Klamath County. A Liability Waiver and Hold Harmless Agreement will be signed by the City and returned to DDS. The waiver is included in this packet.
Recommended Motion: Approve the Waiver of Liability and Hold Harmless Agreement for DDS to contribute $50,000 to the City of Klamath Falls for the Pump Track at Eulalona Park and authorize DDS Director Myles Maxey to sign the agreement. Fiscal Impact: The cost is a $50,000 expenditure. The expenditure will be paid out of the Developmental Disabilities Services Reserve materials and services budget.
Background: Agreement # 179272 allows Klamath County Public Health (KCPH) to participate in the Medicaid Administrative Claiming (MAC) program. Participation in this program allows us to claim Federal Financial Participation (FFP) for our work in providing administrative activities for the state Medicaid plan. These activities include outreach and application assistance for Medicaid as well as system coordination to Medicaid services. FFP is reimbursable through quarterly claims which are based on time studies of allowable MAC activities. This agreement is effective from July 1, 2023 to June 30, 2028.
Recommended Motion: Move to approve Agreement #179272 Intergovernmental Agreement (IGA) between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). Fiscal impact is reimbursement up to $118,000 per fiscal year not to exceed $590,000 during the period of this agreement. Authorize the Department Head to sign the agreement.
Background: KCPH has been a contracted provider with Regence BCBS since March 2016. This updated provider agreement is to comply with current regulatory requirements. The reimbursement rates for our facility are not changed by this agreement.
Recommended Motion: Move to approve the Provider Agreement between Regence Blue Cross Blue Shield (BCBS) and Klamath County Public Health (KCPH). No fiscal impact. Authorize the Department Head to sign the agreement.
Background: In March 2022 KCPH was awarded a $40,000 to provide the funding and structure to create a comprehensive smoke response plan that would include community education, agreements with entities that perform prescribed burns, preparedness activities, and community partnerships to identify resources for vulnerable citizens during smoke events. KCPH was able to complete the work for $20,000, so this amendment modifies the contract to reflect the reduced amount.
Recommended Motion: Move to approve amendment 2 to agreement 045-22 between the Oregon Department of Environmental Quality and Klamath County Public Health. Fiscal impact is a reduction of $20,000 to the grant award. Authorize department head to sign.
Background: In January of 2020, KCPH and Cascade Health Alliance (CHA) signed a Provider Medical Services Agreement. CHA is a coordinated care organization, contracted with Oregon Health Authority to provide local Oregon Health Plan (OHP) Medicaid services. OHA updated its Required OHP Contract Language. This amendment replaces that language, which was paragraph 11.14 and exhibit 11.14, and replaces it with Attachment B.
