Background: On April 25, 2023, the Klamath County Planning Commission held a public hearing and heard a Comprehensive Plan request to amend three articles within the Klamath County Land Development Code:
This change is response to request from the local develop committee. Since permitting has become more involved with other agencies it is no longer feasible to obtain a building permit within a 180 days from the issuance of a final order for a project, it make sense to edit the code establishing a time limit in which the developer can work comfortably without the fear of potentially losing an approval
The Board of County Commissioners after listening to the Planning Commission hearing, deliberated and unanimously approved the requested Comprehensive Plan and Zone Change, based on the findings and recommendation of the Planning Commission.
Recommended Motion: Approve to sign the Final Order and Ordinance rendering the prior approved decision into writing.
Fiscal Impact: There is no fiscal impact to Klamath County.
Background: On April 25, 2023, the Klamath County Planning Commission held a public hearing and heard a Comprehensive Plan request to amend Article 82 (Camping) within the Klamath County Land Development Code.
On May 31, 2017, the Board of County Commissioners adopted amendment to Article 82 via Ordinance 45.89 limiting the number a person could camp on private property from 120 days to 21 days and added the language regarding camping during sanctioned hunting seasons. The rational of allowing an exemption for hunting was many hunters enjoy hunting both deer and elk along with other game. The combination of the different was more than 21 days, however the lengthy season such as cougar or bear season was not concerned.
A few Individual have used the length of cougar season to their advantage by permanently camping claiming to be cougar hunting. The current language has made it harder for Code Enforcement to take the action on certain cases.
Other proposed changes include the removal of allowing sumps or pit prives as acceptable method of disposing of sewage. The proposed changes would limit the sewage disposal to self-contained recreation vehicles or porta potties.

Background: In accordance with ORS 311.795 (2) and (3) A County governing body may cancel all delinquent real/personal property taxes and interest and penalties due thereon from any taxpayer where the total of the same is $10 or less, when in the judgment of the county governing body the cost of collecting the same will be greater than the amount to be collected.
Recommended Motion: Approve and execute the attached Order so the Tax Collector can cancel all delinquent real/personal property taxes and interest and penalties under $10 for the 2022-23 tax year, in accordance to ORS 311.795 section 2 and 3. Fiscal Impact of $2,428.63 uncollected revenue for the 2022-23 tax year.
Background: This budget resolution records the actual revenue of interest received and beginning fund balance as well as records the full amount that will be paid to the City of Klamath Falls to close this fund.
Recommended Motion: Approve the supplemental budget resolution for fiscal year 2022-23 as outlined in the attached document. Fiscal Impact: $10,493.00 increase in revenues and expenditures to the Klamath Falls Street fund.
Background: During the April 26, 2023 Finance meeting, the Klamath County Board of Commissioners authorized $15,000 to Klamath IDEA to assist in funding the entrepreneur-focused economic development plan. A contract for services is now signed by the Klamath Community College Foundation Board Chair and presented for signature by the Klamath County Board of Commissioners.
Recommended Motion: Approve and sign the contract with Klamath Community College Foundation DBA Klamath IDEA to promote economic development. Fiscal impact of $15,000.00 expenditure to the Economic Development Fund in FY 2023-2024.
Background: The American Rescue Plan Act Grant Allocation Committee met on January 18, 2023 to hear presentations from eligible grant applications to the Board of County Commissioners (BOCC) for funding. The ARPA Grant Allocation Committee reviewed the recommendations and approved funding to grant recipients on January 19, 2023 for the applicants as detailed below:

All grant submission requirements have been satisfied and the contract is complete and signed by grantee.
Recommended Motion: Approve and sign the Klamath County American Rescue Plan Act Grant agreement. Fiscal impact: $135,000.00 expenditure from the COVID19 Pandemic Grant fund.
Background: The Domestic Well Grant Review Panel met on May 5, 2022 to review and recommend grant applications to the Board of County Commissioners (BOCC) for funding. The BOCC reviewed the recommendations and approved funding to grant recipients during the Admin meeting on June 7, 2022. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

Background: Amerititle would like to enter into a lease for spots 29-32 in Parking Lot 4 from Klamath County particularly described as Klamath Falls Original, Block 36, Lot 2 & 4 POR all 3. Property ID 766889 Map tax lot 3809-032AC-01900. Fiscal impact of $528 revenue to Klamath County Maintenance Dept., Rental Income Fund.
Recommended Motion: Approve and sign lease with Amerititle for spaces 29-32 of Parking lot 4. Fiscal impact is a $528 revenue to Klamath County Maintenance Dept., Rental Income Fund.
Background: Klamath County Public Health (KCPH) would like to have a booth at the Downtown Association’s Third Thursday events. We plan to offer education on a variety of our programs.
Recommended Motion: Move to approve KCPH’s application for Third Thursday. Fiscal impact is $160 from admin sub department 4039. Authorize department head to sign.
Background: Agreement # 170712, approved by the Board of County Commissioners on August 17 2021, delegates the authority to provide environmental health inspections of licensed facilities to Klamath County Public Health (KCPH). This agreement also authorizes KCPH to access fees for these services. In accordance with Oregon Revised Statutes (446.425, 448.035, and 624.490) KCPH must pay a remittance percentage of fees to the state, this amendment updates those fees. The funds from these remittance payments are used for technical support of the statewide licensing system, as well as other state functions that support local public health authorities. The amendment is effective June 30, 2023 through June 30, 2029.
Recommended Motion: Move to approve Amendment #1 to Intergovernmental Agreement (IGA) # 170712 for the provision of Environmental Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County Public Health. Fiscal Impact is estimated revenue of $250,000 to Public Health Environmental Health (sub department 4041). Estimated expense from payment of remittance fees for food facilities (12.22%), as well as tourist (15%) and pool facilities ($90 per license) of $26,000. These estimates are based on the current number of facilities currently operated in Klamath County, and are subject to change as facility numbers increase or decrease. Authorize Department Head to sign.
Background: The printers/fax/copiers located in the Jail Booking area are no longer serviceable by RICOH, due to age and obsolescence of replacement parts. Lieutenant Stripling has worked with the County I.T. Department to obtain quotes for new machines and has determined the RICOH IM430fb is the best option. Order number 98792v1, two units are being purchased for $2,995.90. The agreement will provide preventative maintenance and toner cartridges. The term is 60 months from the date the machines are installed. Estimated quarterly expense of $244 based on $.0103 per B&W copy @ 16,700 copies per quarter.
Recommended Motion: To approve the Klamath County Sheriff to enter into and sign an agreement with RICOH for maintenance and toner for two RICOH IM430fb. Fiscal Impact: Estimated expense to the General Fund-Sheriff’s Office-Corrections is $2,995.90 for the printer purchase and $81 for the remainder of the fiscal year and $976 for full subsequent years for the maintenance agreement.
Background: The Oregon Timber Counties Coalition (OTCC) is an organization comprised of Counties whose economies and cultures have for generations been directly linked to the health and management of the National Forest in Oregon. Impediments to public access, large stand replacement fires, unsustainable increases in fuel, declining revenues for Counties, and burdensome, time consuming rules and regulations are just a sample of current conditions on many of our National Forests. In an effort to address these and other issues OTCC is committed to work with and support Congressional members, Forest Supervisors, Staff, and Employees to accelerate the pace and scale of projects, proposals, and plans that will increase the productivity and overall health of Oregon's National Forests. The focus will be, but not limited to, the receipt of timber harvest receipts and other revenues for counties, public access to public lands and the counties involvement with forest management decisions, and any other issues that may arise.
Recommended Motion: Approve and authorize Commissioner DeGroot to sign attached MOU for participation in the Oregon Timber Counties Coalition. Fiscal Impact: Expenditure of $15,000.00 to from General Fund Non-Departmental.
