Public Hearings

1.

TIME CERTAIN 1:15pm: In the matter of holding the first hearing on proposed Ordinance #96.00

Background: The BOCC desires to balance the needs of the homeless to be able to sleep and rest in safe areas with the need of other citizens to feel safe and be able to access the public areas of the County without hinderance.  The Oregon legislature has set out certain guidelines for local governments to follow when addressing the homeless issue, therefore the BOCC must adopt an ordinance setting forth those guidelines.   Today is the first of two hearings to receive public comment and testimony on the proposed ordinance.  

Recommended Motion: Hold the first hearing for discussion and the taking of public comment and testimony (if any) on the proposed Ordinance.  The second and final hearing is scheduled for June 20, 2023 @ 1:15 p.m. Fiscal impact: Publication costs to the Herald and News for the hearings - $128.46 from the BOCC legal notice publish budget 1000-1050-1051-1000-62030

Bids/Awards/Proposals

1.

In the matter of requesting approval of the purchase of a 2023 Ford F250; to include up-fit for the Sheriff’s Office Search and Rescue Division, Chris Kaber, Sheriff

Background: The purchases from Lithia Ford of Klamath Falls. Purchases to include one 2023 Ford F250 and SAR upfit, for the Search and Rescue division. The purchase of the vehicle and all applicable equipment no to exceed $70,000. No vehicles were available on any state contract agreements. After contacting Gresham Ford, Landmark Ford, and Power Ford, Lithia Dodge was the only dealership able to order and receive this vehicle. 

Recommended Motion: Approve the Klamath County Sheriff’s Office to accept the quote and to sign for the purchase of one 2023 Ford F250 from Lithia Ford of Klamath Falls. Fiscal Impact: Expenditures not to exceed $70,000 to be paid from the Sheriff’s Special Revenue - Search and Rescue Fund.

1.

In the matter of appointing Nicholas Oldham and Fred Ginestar to the Poe Valley Vector Control District Board. - BOCC

Background: The Poe Valley Vector Control District Board has vacancies and has recommended appointment of Nicholas Oldham and Fred Ginestar who are willing, able and eligible to serve a term on the Board.

Recommended Motion: Approve and sign the attached Order appointing Nicholas Oldham and Fred Ginestar to the Poe Valley Vector Control District Board.  There is no fiscal impact.


2.

In the matter of reappointing Diann Walker-Pope and Matthew Gray to the Ambulance Advisory Committee. - BOCC

Background: The Ambulance Advisory Committee has vacancies and has recommended the above named applicants who are willing, able and eligible to serve a term on the Committee commencing this day and expiring December 31, 2025.

Recommended Motion: Approve and sign the attached Order appointing Diann Walker-Pope and Matthew Gray to the Ambulance Advisory Committee. There is no Fiscal Impact.

Agreements

1.

In the matter of signing the Klamath County Logo Usage Agreement with Klamath Wingwatchers. - Natalie Parker, Grant Manager

Background: Klamath Wingwatchers has been approved for a Tourism Grant award. KlamathWingwatchers wishes to enter into an agreement for use of the Klamath County Logo.

Recommended Motion: Approve and authorize Chair to sign the Klamath County Logo Usage Agreement constituting a non-exclusive license granted by Klamath County to Klamath Wingwatchers for use of the County’s name and/or logo under the terms and conditions of the attached agreement. Fiscal impact: None.

2.

In the matter of approving and signing Klamath County Domestic Well Financial Assistance Grant Agreements - Natalie Parker, Grant Manager

Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

FRISENDAHL, FREDERICK        $2,356.50

GRIFFITH, MARY                        $5,721.00

SOUZA, PATRICIA                      $8,040.00

Recommended Motion: Approve and sign the Klamath County Domestic Well Financial Assistance Grant agreements with above recipients. Fiscal impact: $16,117.50 expenditure from the Commissioners Miscellaneous Grant Fund.

3.

In the matter of approving and signing Klamath County American Rescue Act grant agreements for the completed and ready applicants – Natalie Parker, Grant Manager

Background: The American Rescue Plan Act Grant Allocation Committee met to hear presentations from eligible grant applications to the Board of County Commissioners (BOCC) for funding. The ARPA Grant Allocation Committee reviewed the recommendations and approved funding to the grant recipient as detailed below:

KCEDA $1,000,000.00; Skyline Brewing Co. $ 45,000.00

All grant submission requirements have been satisfied and the contract is complete and signed by grantee.

Recommended Motion: Approve and sign the Klamath County American Rescue Plan Act Grant agreement. Fiscal impact: $1,045,000.00 expenditure from the COVID19 Pandemic Grant fund.

4.

In the matter of approving and authorizing the chair to sign the cooperative agreement with USDA for APHIS Wildlife Services - Natalie Parker, Grant Manager

Background: The purpose of the Wolf Depredation Compensation and Financial Assistance Agreement is to assist the County in supporting the implementation of non-lethal wolf damage management techniques and strategies by livestock producers in areas where wolf depredation of livestock is on-going and to provide compensation for injury or death to livestock resulting from wolf depredation.

Recommended Motion: Approve and authorize the chair to sign the US Department of Agriculture for USDA APHIS Wildlife Services and the Cooperative Agreement. Fiscal impact of $17,000.00 expenditure from the Commissioners Miscellaneous Grant Fund - Wolf Depredation Grant.

5.

In the matter of providing amendment #1 to the Title III Contract – BLM O&C Lands Restoration Project between Klamath County and Klamath County Community Corrections. Vickie Noel - Finance

Background:  Amendment #1 is a termination of the Title III Contract signed by Community Corrections on April 23, 2003 for an O&C Lands Restoration Project.  This agreement does not have a termination date.  After speaking with the Director of Community Corrections it was determined that the project will no longer be completed as the original goals cannot continue to be met. 

Recommended Motion:  Approve and sign amendment #1 to the Title III contract – BLM O&C Lands Restoration Project between Klamath County and County Community Corrections.  Fiscal impact:  $161,681.22 will be unallocated in the Title III O&C Lands Original fund.

6.

In the Matter of approving an agreement between Klamath County and Moss Adams LLP for professional audit services for the fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025. Vickie Noel - Finance

Background: Klamath County is required to have an annual audit of its fiscal affairs.  The proposal process has been complete with the Board of County Commissioners accepting the proposal for audit services from Moss Adams LLP on May 16, 2023.  The term of the contract is for the annual audit of each of three fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025 with two optional one-year renewals. The anticipated fees for the fiscal year of the contract are as follows:

        2023 - $81,520    2024 - $85,595    2025 - $89,860

Recommended Motion:  Move to approve the contract between Klamath County and Moss Adams LLP for audit services for fiscal years 2023, 2024, and 2025 with fiscal impact of $256,975 for the full term of the initial contract.

In the Matter of approving an agreement between Klamath County and Moss Adams LLP for professional audit services of the Klamath County Employee’s Pension Plan for the fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025. Vickie Noel - Finance

Background: Klamath County Employee’s Pension Plan is required to have an annual audit of its fiscal affairs.  The proposal process has been complete with the Board of County Commissioners accepting the proposal for audit services from Moss Adams LLP on May 16, 2023.  The term of the contract is for the annual audit of each of three fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025 with two optional one-year renewals. The anticipated fees for the fiscal year of the contract are as follows:

        2023 - $7,500    2024 - $7,875    2025 - $8,265

Recommended Motion:  Move to approve the contract between Klamath County and Moss Adams LLP for audit services for fiscal years 2023, 2024, and 2025 with fiscal impact of $23,640 for the full term of the initial contract.

In the Matter of approving an agreement between Klamath County and Moss Adams LLP for professional audit services of the Klamath County Treasurer’s Investment Pool for the fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025. Vickie Noel - Finance

Background: Klamath County Treasurer’s Investment Pool is required to have an annual audit of its fiscal affairs.  The proposal process has been complete with the Board of County Commissioners accepting the proposal for audit services from Moss Adams LLP on May 16, 2023.  The term of the contract is for the annual audit of each of three fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025 with two optional one-year renewals. The anticipated fees for the fiscal year of the contract are as follows:

        2023 - $7,500    2024 - $7,875    2025 - $8,265

Recommended Motion:  Move to approve the contract between Klamath County and Moss Adams LLP for audit services for fiscal years 2023, 2024, and 2025 with fiscal impact of $23,640 for the full term of the initial contract.


9.

In the matter of approving and signing an Agreement between County and Contractor for Construction of the RV Expansion Project with Rocky Mountain Construction in the amount of $2,669,157.50 for the Klamath County Fairgrounds and Event Center RV lot expansion project. Derrick Rowley, Director/Manager Klamath County Fairgrounds/Event Center

Background:  The Klamath County Fairgrounds/Event Center is in the process of expanding the east RV area from 24 full service sites to 48 full service sites. Two bids were received and opened publicly on May 4, 2023 for this project. The winning bid, meeting all specified criteria, was received from Rocky Mountain Construction. The Contract has been prepared, along with all supporting documentation and is being presented for approval by the Board of County Commissioners. 

Recommended Motion:  Approve and sign the Agreement Between County and Contractor for Construction of the RV Expansion Project (Stipulated Price); and authorize Derrick Rowley, Director/Manager and Rhine-Cross Group, LLC to begin management of the construction phase of this project on behalf of the Fair Board and the County Commissioners. Fiscal Impact: $2,669,157.50

11.

Grants

1.

In the matter of approving and authorizing the chair to sign the EPA Region 10 Community Grant Application – Natalie Parker, Grant Manager

Background: The goal of the Upper Klamath Lake Water Reuse Equipment Project is to reuse irrigation water to improve water supply for ranchers in Wood River District Improvement Company (WRDIC) while reducing nutrient inputs into Upper Klamath Lake from the Wood River Valley. Hollie Cannon sought Board approval during a Work Session on October 12, 2022 with an update on the status of the grant application process on April 12, 2023. This grant funding was awarded through 2022 Congressionally Directed Spending via EPA. WRDIC cannot apply directly for the funding, Klamath County can apply and create a subrecipient relationship with WRDIC to receive this funding.

Recommended Motion: Approve and authorize the chair to sign grant application for $1,351,125.00 with EPA Region 10 Community Grants. Fiscal Impact: None at this time.

12.

Budget Resolutions

1.

Approve a budget change within the General Fund Sheriff Civil Division for FY 2023-24. Vickie Noel - Finance

BACKGROUND:  After the Budget Committee approved the 2023-24 budget, the Board approved a reclassification of the Civil Deputy to a Senior Civil Deputy. This resolution will add $10,795.00 in expenditures to Personnel Services and increase gun permit revenues by the same amount. 

RECOMMENDED MOTION:   Approve the budget resolution as outlined in the attached documents for changes to the General Fund – Sheriff Civil Division.  Fiscal Impact:  Increase in expenditure and revenue categories of $10,795.00.

2.

Approve a budget change within the Klamath Falls Street fund for FY 2023-24. Vickie Noel - Finance

BACKGROUND:    After the Budget Committee approved the 2023-24 budget, the Board voted to pay the City of Klamath Falls Street Department the funds from their County account in full and eliminating the Klamath Falls Street fund from the County budget.

RECOMMENDED MOTION:   Approve the budget resolution as outlined in the attached documents for changes to the Klamath Falls Street fund.  Fiscal Impact:  Decrease in revenues and expenditures of $1,498,000.

Drainage Service District

1.

In the Matter of approving an agreement between Klamath County and Moss Adams LLP for professional audit services of the Klamath County Drainage Service District for the fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025. Vickie Noel - Finance

Background: Klamath County Drainage Service District is required to have an annual audit of its fiscal affairs.  The proposal process has been complete with the Board of County Commissioners accepting the proposal for audit services from Moss Adams LLP on May 16, 2023.  The term of the contract is for the annual audit of each of three fiscal years ending June 30, 2023, June 30, 2024, and June 30, 2025 with two optional one-year renewals. The anticipated fees for the fiscal year of the contract are as follows:

        2023 - $7,500    2024 - $7,875    2025 - $8,265

Recommended Motion:  Move to approve the contract between Klamath County Drainage Service District and  Moss Adams LLP for audit services for fiscal years 2023, 2024, and 2025 with fiscal impact of $23,640 for the full term of the initial contract.
