In the matter of approving and authorizing the chair to sign the Carbon Reduction Program – Electric Vehicle Charging Station – Grant Application – Natalie Parker, Grant Manager

Background: The purpose of the Oregon Department of Transportation (ODOT) Carbon Reduction Program is to reduce transportation greenhouse gas emissions. ODOT’s program for vehicle and fuel technology would be a benefit to Klamath County by increasing the operating efficiency of multiple transportation modes through transitions to more fuel-efficient vehicles, fuels that produce fewer GHG emissions or have lower carbon intensity, and improvements in engine technologies.

Recommended Motion: Motion to approve and authorize the chair to sign for $1,658,800.00 Oregon Department of Transportation Carbon Reduction Program Grant was approved in the May 23, 2023 Administrative Meeting. Fiscal Impact: None.

7.

Bids/Awards/Proposals

1.

In the matter of an authorization to issue an Invitation for Bids for the 2023 Sprague River Road Overlay project. Jeremy Morris, Public Works

Background: Klamath County Public Works (KCPW) is requesting bids for asphalt overlaying +/-6 miles of 2-lane rural county road with cold plane pavement removal transition grinding, mailbox pull-out and approach transition paving on Sprague River Road.  The engineers estimate is $2,000,000.  While this project is listed on the KCPW 5-year capital improvement plan, accelerated pavement deterioration requires that critical portions of the roadway be addressed this year rather than summer of 2024 as originally scheduled.

Recommended Motion:  Board approve and authorize the Public Works Department to issue an Invitation for Bids for the 2023 Sprague River Road Overlay project.  Fiscal Impact is to be determined.

Resolutions

1.

Resolution Adopting the revisions to the Klamath County Contracting Policies and Procedures Chapter 1 section 1.19 (2). Contracts/Counsel-Leslie Barlow-Hunter

Background: Chapter 279 of the Oregon Revised Statutes (ORS) establishes rule and authority pertaining to the procurement of goods and services by public agencies and provides for public contracting agencies to adopt their own rules of procedure for public contracting. Klamath County has contracting policies and procedures in place that incorporate both the Attorney General's Model rules (Oregon Administrative Rules, Chapter 137) and the rules developed by the Department of Administrative Services (Oregon Administrative Rules, Chapter 125). A public contracting agency must review their contracting rules each time the Attorney General adopts a modification of the model rules to ensure compliance with statutory changes pursuant to ORS 279.A065(6)(b). The Revised Klamath County, Oregon Contracting Policies and Procedures have been reviewed and updated by the Contract & Risk Manager and Klamath County Counsel. The revisions to the Klamath County Contracting Policies and Procedures Chapter 1 section 1.19 (2), Departmental Spending Authority, will adjust policy to authorize Department Heads the authority to sign a PO or invoice for a current fiscal year budgeted purchase, of goods and services in an amount up to $10,000.00, per purchase. The PO/invoice shall not include any terms and conditions, service agreements, etc. that would further obligate Klamath County. This authorization is to strictly authorize a signature for the acceptance of a quote for the purchase of the supplies or services as described in section (1.19(2)). This revision was discussed during the May 10, 2023 County Counsel Public Meeting.

 Recommended Motion: That the Klamath County Board of Commissioners approve and sign the attached Resolution that adopts the revisions to the Klamath County Contracting Policies and Procedures Chapter 1 section 1.19 (2), as discussed above. No fiscal impact.

Orders

1.

In the matter of appointing individuals to the Spence Mountain Maintenance Advisory Committee. - BOCC

Background: The Spence Mountain Maintenance Advisory Committee was established by resolution on January 10. The Commissioners  have called out seven specific positions for representation; Klamath Tribes, Trails/Recreation, Agriculture, Industry, County and two At Large. Applications were received and interviews were conducted for those positions that had multiple applicants.  Mark Cruz, Drew Honzel, Marc Staunton, John Davis, Kirby Garlitz, Hannah Levine and Jason Pettigrew are willing, able and eligible to serve a term on the Committee commencing this day and expiring December 31, 2025.

Recommended Motion: Approve and sign the attached Order appointing Mark Cruz, Drew Honzel, Marc Staunton, John Davis, Kirby Garlitz, Hannah Levine and Jason Pettigrew to specified positions on the Spence Mountain Maintenance Advisory Committee.  There is no Fiscal Impact.

Drainage Service District

Background:   The purpose of this hearing is to discuss the Klamath County Drainage Service District Budget for the fiscal year 2023-2024 as advertised.  Time certain 1:15 pm.

Recommended Motion:   Hold the hearing on the Klamath County Drainage Service District budget for 2023-2024. Fiscal impact is $323.44 Expenditure to the Drainage District Operating Budget.

In the Matter of Adoption of the Klamath County Drainage Service District Budget for Fiscal Year 2023-2024 and making appropriations. Vickie Noel - Finance Director

Background:  The Budget Committee approved the budget on April 18, 2023.  A public hearing was advertised and held on June 13, 2023.  There have been no adjustments to the approved budget.  The Board of Directors approves and appropriates the District budget for fiscal year 2023-2024 effective July 1, 2023.

Recommended Motion:   The Board of Directors hereby adopts the budget for fiscal year 2023-2024 now on file with Klamath County Board of Commissioners in the sum of $2,950,000.  The Board of Directors resolves that the amounts for the fiscal year beginning July 1, 2023, and for the purposes specified in the resolution are hereby appropriated.

In the Matter of Imposing Assessment of the Klamath County Drainage Service District for Fiscal Year 2023-2024. Vickie Noel - Finance

Background:   The Klamath County Drainage Service District budget for fiscal year 2023-2024 was adopted on June 13, 2023 for the fiscal year beginning July 1, 2023 that contains an assessment of $24.00 per tax lot. The Board of Directors is required to adopt a resolution imposing the assessment for the tax year 2023-2024 upon the tax lots within the district boundaries.

Recommended Motion:   The Board of Directors hereby imposes the assessment provided for in the adopted budget at the rate of $24.00 per tax lot for the tax year 2023-2024 upon all tax lots within the district effective July 1, 2023.  Fiscal Impact:  $190,000 estimated assessment revenue.

In the Matter of Designating Klamath County Drainage Service District Positions Authorized to Expend and Encumber District Funds for the Fiscal Year 2023-2024. Vickie Noel - Finance

Background: The Klamath County Drainage Service District budget for fiscal year 2023-2024 was adopted on June 13, 2023.  The Board of Directors are responsible for all District expenditures, and have chosen to delegate the authority to make expenditures and/or encumber District Funds to the attached positions effective July 1, 2023.

Recommended Motion:   The Board of Directors hereby authorizes the positions in the attached resolution to make expenditures and make encumbrances of District funds effective July 1, 2023.

Background:  The Budget Committee approved the budget on April 18, 2023.  A public hearing was advertised and held on June 13, 2023. There were no adjustments to the approved budget. The Board of Directors approves and appropriates the District budget for fiscal year 2023-24 effective July 1, 2023.

Recommended Motion: The Board of Directors hereby adopts the budget for fiscal year 2023-24 now on file with Klamath County Board of Commissioners in the sum of $6,105,425.  The Board of Directors resolves that the amounts for the fiscal year beginning July 1, 2023, and for the purposes specified in the resolution are hereby appropriated.


3.

In the Matter of Imposing and Categorizing Taxes of the Klamath County Library Service District for Fiscal Year 2023-2024. Vickie Noel - Finance

Background:   The Klamath County Library Service District budget for fiscal year 2023-24 was adopted on June 13, 2023 for the fiscal year beginning July 1, 2023 that contains ad valorem tax at the rate of $0.4900 per $1,000 of assessed value for the General Fund.  The Board of Directors is required to adopt resolutions imposing and categorizing the tax for the tax year 2023-24 upon the assessed value of all taxable property within the district boundaries.

Recommended Motion:  The Board of Directors hereby imposes the taxes provided for in the adopted budget at the rate of $0.4900 per $1,000 of assessed value for the tax year 2023-24 upon the assessed value of all taxable property within the district effective July 1, 2023.  Fiscal Impact:  $2,927,400 estimated ad valorem property tax revenue.

In the Matter of Designating Klamath County Library Service District Positions Authorized to Expend and Encumber District Funds for the Fiscal Year 2023-24. Vickie Noel - Finance

Background: The Klamath County Library Service District budget for fiscal year 2023-24 was adopted on June 13, 2023.  The Board of Directors are responsible for all District expenditures, and have chosen to delegate the authority to make expenditures and/or encumber District Funds to the attached positions effective July 1, 2023.

Recommended Motion:   The Board of Directors hereby authorizes the positions to make expenditures and make encumbrances of District funds effective July 1, 2023.  There is no fiscal impact.


5.

In the matter of authorizing the Library Director to sign an agreement between Basin Partners Internship Program (BPIP) and the Klamath County Library Service District - Library -Nathalie Johnston

Background: Basin Partners Internship Program (BPIP) and the Klamath County Library Service District agree to cooperate in providing a career-based learning experience for an high school trainee. The trainee is expected to intern at the South Suburban library for 120 hours between June 19th and July 21st .  

Recommended Motion:  Authorize the Library Director to sign an agreement between Basin Partners Internship Program (BPIP) and the Klamath County Library Service District. Fiscal impact $1,200 from Contract Personnel 2510-5010-5011-62005

In the Matter of Imposing and Categorizing Taxes of the Klamath County Extension Service District for Fiscal Year 2023-24. Vickie Noel - Finance

Background:   The Klamath County Extension Service District budget for fiscal year 2023-24 was adopted on June 13, 2023 for the fiscal year beginning July 1, 2023 that contains ad valorem tax at the rate of $0.1500 per $1,000 of assessed value for the General Fund. The Board of Directors is required to adopt a resolution imposing and categorizing tax for the tax year 2023-24 upon the assessed value of all taxable property within the district boundaries.

Recommended Motion:   The Board of Directors hereby imposes the taxes provided for in the adopted budget at the rate of $0.1500 per $1,000 of assessed value for the tax year 2023-24 upon the assessed value of all taxable property within the district effective July 1, 2023.  Fiscal Impact is $912,020 estimated Ad Valorem Property Taxes for fiscal year 2023-24.

In the Matter of Designating Klamath County Extension Service District Positions Authorized to Expend and Encumber District Funds for the Fiscal Year 2023-24. Vickie Noel - Finance

In the Matter of Adoption of the Klamath County Budget for Fiscal Year 2023-2024 and Making Appropriations. Vickie Noel - Finance

Background:  The Budget Committee approved the budget on April 19, 2023 and an amended total budget amount on May 23, 2023.  A public hearing was advertised and held on June 13, 2023 and final adjustments to the budget were made according to Oregon Statute 294.456 (1).  The Board of County Commissioners approves and appropriates the budget for fiscal year 2023-24 effective July 1, 2023.

In the Matter of Imposing and Categorizing Taxes of Klamath County, Oregon for Fiscal Year 2023-2024. Vickie Noel - Finance

Background:  The Klamath County, Oregon budget for fiscal year 2023-2024 was adopted on June 13, 2023 for the fiscal year beginning July 1, 2023 that contains ad valorem tax at the rate of $1.68610 per $1,000 of assessed value for the General Fund, $0.04650 per $1,000 of assessed value for the Veterans Service Fund and $0.05000 per $1,000 of assessed value for the Museum Fund.  The Board of Commissioners is required to adopt a resolution imposing and categorizing the tax for the tax year 2023-2024 upon the assessed value of all taxable property within Klamath County.

Recommended Motion: The Board of Commissioners hereby imposes the taxes provided for in the adopted budget at the rate of $1.73260 per $1,000 of assessed value for a permanent rate levy for operations and $0.05000 per $1,000 of assessed value for a local option rate levy for the Museum Fund for the tax year 2023-24 upon the assessed value of all taxable property within Klamath County effective July 1, 2023.  The Board of Commissioners hereby categorizes the taxes as General Fund at the rate of $1.68610 per $1,000 of assessed value, Veterans Service Fund at the rate of $0.04650 per $1,000 of assessed value, and Museum Fund at the rate of $0.05000 per $1,000 of assessed value.  Fiscal Impact: $10,300,000 estimated Ad Valorem Property Taxes.

Background:  The Klamath County budget for fiscal year 2023-2024 was adopted on June 13, 2023.  The Board of Commissioners are responsible for all Klamath County expenditures, and have chosen to delegate the authority to make expenditures and/or encumber County funds to the attached positions effective July 1, 2023.

Recommended Motion:  The Board of Commissioners hereby authorizes the attached positions to make expenditures and make encumbrances of County funds effective July 1, 2023.  No fiscal impact.  


15.

Agreements

1.

In the Matter of approving an agreement with Klamath Falls Downtown Association and Klamath County Developmental Disabilities Services to participate in Third Thursday 2023. Heidi Gaither, DDS

Background: Developmental Disabilities Services (KCDDS) would like to again participate in the Klamath Falls Downtown Association Third Thursday event, as a means of community outreach. Per the agreement with the KF Downtown Association, KCDDS must provide proof of insurance with a $1,000,000 limit per each occurrence and $2,000,000 aggregate limit. KCDDS would also pay a registration fee of $160.00 to participate in all three Third Thursday events (June 16, July 20 and August 17).  

 Recommended Motion:  Approve the agreement and provide proof of insurance to the Klamath Falls Downtown Association for  KCDDS to register as a participant in their Third Thursday 2023 event. Fiscal Impact: $160.00

2.

In the matter of approving Task Order H to the Master Agreement between Oregon Tech and Klamath County Public Health (KCPH). –Jennifer Little, Public Health

Background:  Klamath County Public Health (KCPH) would like to host a student intern from Oregon Tech’s Population Health Management program during the summer term. KCPH has a master agreement with Oregon Tech, and this would be a new task order, Exhibit H. 

Recommended Motion:  Move to approve Task Order H to the Master Agreement between Oregon Tech and Klamath County Public Health. No fiscal impact. Authorize department head to sign.

3.

In the Matter of approving the Memorandum of Understanding (MoU) between Klamath County Community Corrections and Klamath Irrigation District. Aaron Hartman, Klamath County Community Corrections

Background: Klamath County Community Corrections will provide Klamath Irrigation District supervised community service work crews to maintain vegetation along the A-Canal for a maximum of two (2) rounds per year.  This agreement will begin on July 1, 2023 and go through June 30, 2024. 

Recommended Motion:  Approve the MoU with Klamath County Community Corrections and Klamath Irrigation District and authorize Aaron Hartman to sign on behalf of the county. Fiscal Impact: Revenue not to exceed $4,800.00 annually to KCCC operating fund.

In the matter of approving and signing Klamath County American Rescue Act grant agreements for the completed and ready applicants – Natalie Parker, Grant Manager

Background: The American Rescue Plan Act Grant Allocation Committee met to hear presentations from eligible grant applications to the Board of County Commissioners (BOCC) for funding. The ARPA Grant Allocation Committee reviewed the recommendations and approved funding to the grant recipient as detailed below:

Crescent Gilchrist Community Action Team $34,814.00

All grant submission requirements have been satisfied and the contract is complete and signed by grantee.

Recommended Motion: Approve and sign the Klamath County American Rescue Plan Act Grant agreement. Fiscal impact: $34,814.00 expenditure from the COVID19 Pandemic Grant fund.

5.

In the matter of approving and signing Klamath County Domestic Well Financial Assistance Grant Agreements - Natalie Parker, Grant Manager

Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

MCBEE, RAYMOND & TRISHA $ 1,706.25

PETERSEN, IRVIN & KAREN $16,000.58

Recommended Motion: Approve and sign the Klamath County Domestic Well Financial Assistance Grant agreements with above recipients. Fiscal impact: $17,706.83 expenditure from the Commissioners Miscellaneous Grant Fund.

6.

In the matter of accepting Federal Clean Vessel Act (CVA) grant funds, and approving an Intergovernmental Agreement between the State of Oregon, acting by and through the State Marine Board and the Klamath County Parks Department. Tom Crist, CDD Parks Division

Background: The State of Oregon, acting by and through the State Marine Board is authorized to provide grant funds for boating facilities. The County Parks is replacing the steel guide line for the floating restroom to reduce costs of regularly replacing the buoy, chain and anchor due to inclement weather. To cover the costs, a Small Grant application that utilizes federal funding was submitted for review and approval. The Small Grant #2223-08 in the amount of $2,000.00 was approved, the project should be completed, and final payment made by June 30, 2023. The total cost of the project is $3,257.00. The County will receive $2,000.00 in Federal (CVA) funds, and provide $913.00 in matching cash funds, and $344.00 in force labor. 

Fiscal Impact: $2,000.00 Federal grant revenue to the Parks budget, $913.00 in matching cash funds and $344.00 in force labor.    

Recommended Motion:  Accept Federal Clean Vessel Act (CVA) grant funds, and approve an Intergovernmental Agreement No. 2223-08 between the State of Oregon, acting by and through the State Marine Board and the Klamath County Parks Department; authorize the Parks Manager to sign the agreement. Fiscal impact; $2,000.00 Federal grant revenue to the Parks budget, expense $913.00 in matching cash resources, and $344.00 in force labor.
