Background: This budget resolution transfers the 2023-24 budget from the Sheriff’s Office to the General Fund Emergency Management Department. This resolution is necessary as the final adopted budget for 23-24 was approved and submitted to the State of Oregon.

Background: The Klamath County Wolf Depredation Advisory Council met on January 5, 2023 to discuss wolf activity in Klamath County. The advisory committee recommended the purchase of two drones for non-lethal assistance by the USDA/APHIS range-riders already dedicated to

Background: The property owner of the two lots is Stacy Parrott who has signed a petition requesting this action. Vacating the lots will not be detrimental to the public. The Planning Director’s Report recommends that the two lots be vacated from the subdivision. The applicant paid the $600 application fee to process the request to vacate the lots. Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

Background: The property owner of the two lots is Justin Pruitt who has signed a petition requesting this action. Vacating the lots will not be detrimental to the public. This vacation is different than a typical vacation. Lots 36 and 37 were vacated via Ordinance 2022-047 creating one property. The applicant now wishes to vacate lot 35 adding it to the property consisting of vacate lots 36 and 37. The Planning Director’s Report recommends that the three lots be vacated from the subdivision. The applicant paid the $600 application fee to process the request to vacate the lots. Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

Background: Klamath County Information Technology accepted the proposal from SoftwareOne for the Microsoft Enterprise Agreement renewal on May 16th and an agreement with Microsoft was brought before the Board on June 25th. The IT Department now needs to enter into the agreement with SoftwareOne for the purchase of our Microsoft licensing. The total of the agreement will be $138,301.68 per year for a term of 3 years, with a total cost of $414,905.04.
Recommended Motion: The Board accepts the agreement with SoftwareOne. The total fiscal impact is to be $138,301.68 per year for 3 years, with the total cost being $414,905.04. This is to be paid from the Technology Maintenance Fund. This agreement will commence on July 25, 2023.
Background: The Klamath County Wolf Depredation Advisory Council met on January 5, 2023 to discuss wolf activity in Klamath County. The advisory committee recommended hosting a conference with USDA/APHIS and Western Landowners Alliance for public information and education regarding Wolf activity in Klamath County. The conference will be held August 23-24, 2023.
Recommended Motion: Approve the agreement with Klamath County Fairgrounds and authorize Finance Director to sign rental agreement. Fiscal Impact: $2,134.04 from the ODA Wolf Depredation Grant in the Commissioners Miscellaneous Grant Fund.
Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

Background: The proposed contract for KCR program placements was received from OYA on July 3, 2023. The Klamath County Juvenile Department has operated the KCR program since 2014 to provide Behavioral Rehabilitation Service (BRS) stabilization services for OYA clients.
Recommended Motion: Board accepts the contract from the Oregon Youth Authority for the Juvenile Department KCR program. Fiscal Impact; up to $3,283,797.59 to be paid by OYA to the Klamath County Juvenile Department for the placement of OYA clients in the KCR program during the 2023-2025 biennium. The BOCC authorizes the juvenile director to sign the contract.
Background: Agreement #169517, which became effective July 1, 2021, delegates authority to Klamath County Public Health to operate public health programs in Klamath County. This amendment updates Exhibit C, the Financial Assistance Award for fiscal year 2023, to de-obligate funds for the fentanyl campaign funds. This funding will be added to the FY 24 award by a separate amendment.
Recommended Motion: Move to approve Amendment #14 to Intergovernmental Agreement (IGA) #169517 for the Financing of Public Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). Fiscal impact is decreased grant award for FY 23 of 3,272 to sub department 4049 Overdose Prevention, fentanyl campaign funds. Authorize the Department Head to sign.
Issue: In the matter of the Board approving Amendment #2 to the Contract between Klamath County and Castle Tire & Recycling.
Background: Castle Tire & Recycling, is the current service provider for the removal of scrap tires from the Klamath Falls Landfill. The current contract will expire on July 31, 2023, both parties mutually consent to extend the contract. This amendment extends the contract for one (1) additional five (5) year term and will expire on July 31, 2023.
Recommended Motion: Approve and sign Amendment #2 to the Contract between Klamath County and Castle Tire & Recycling. This Amendment extends the contract for one (1) additional five (5) year term and will expire on July 31, 2028. Fiscal Impact; Continued charge of $1,080 per 28’ trailer of scrap tires.
Background: The DCBS launched a Wildfire Hardening Grant Program (“Grant Program”) which provides grant dollars to aid qualifying residences or owners of structures in the 2020 wildfire, for replacement or repair of specific items outlined by the program. Klamath County Building agreed to work together to implement and administer the (“Grant Program”) which is based on OAR 918-001-5000 through OAR 918-001-5070. This amendment reinstates the agreement, updates the Contract Administrator information, purpose, statement of work and extends the term until December 31, 2025.
Recommended Motion: Approve amendment #1 to an IGA between Klamath County and the State of Oregon, acting by and through its Department of Consumer and Business Services; this amendment reinstates the agreement, updates the Contract Administrator information, purpose, statement of work and extends the term until December 31, 2025. Authorize Building official to sign agreement; Fiscal Impact, none.
Background: By the authority of ORS 190.110; the County as a unit of local government, may cooperate with and enter into intergovernmental agreements for any lawful purpose with a federally recognized Indian tribe. Klamath County shall act as consultants to perform all commercial plan reviews and related inspections as directed by the Tribes for the Tribal Court interior remodel. Estimated consulting hours are included as Exhibit “A”; this agreement shall expire on December 31, 2023.
Recommended Motion: Approve Memorandum of Agreement with Klamath Tribes, a federally recognized Indian tribe, acting by and through the Klamath Tribal Planning Department for the purpose of the Building Department to provide building code consulting and related services to the tribes; this agreement shall expire on December 31, 2023; authorize the Building Official to sign agreement; Fiscal Impact, revenues estimated at $1,771.50 to the Building Department.
Background: Klamath County enters into agreements with outside agencies to treat noxious weed infestations on their property. The purpose of this agreement is to treat noxious weed-infested areas of State Parks ownership. The location of the treatment is the OC&E Woods Line State Trail from the end of pavement west of Washburn Way in Klamath Falls to Hwy 140 at Olene.
Recommended Motion: Board to approve and sign the agreement between Klamath County and the State of Oregon acting by and through its Parks and Recreation Department for noxious weed control. Fiscal Impact not to exceed $2,000.00 income to the Weed Control Budget.
Background: Klamath County Public Works would like to enter into a direct appointment with ZCS Engineering Architecture for the Swan Lake Bridge rehabilitation project. ZCS is providing as-built verification and structural engineering services from design through construction per the attached scope of work.
The 2023 Klamath County contracting policies and procedures section 3.15, Selection for Architect or Engineering Services (1) allow use direct appointment (OAR 137-048-0200 ) if estimated fee is less than $100,000.00.
Recommended Motion: Board to approve and sign the contract between Klamath County and ZCS Engineering Architecture for the Swan Lake Bridge (35C197) Rehabilitation project. Fiscal Impact not to exceed $39,000.00 expense to the Road Operating Budget.
Background: Skysol, LLC entered into a PILOT agreement in December of 2016 and due to delay of project is anticipated to be completed August 2023. Skysol, LLC will build a 55-megawatt solar energy generation facility located near Malin, Oregon. The facility will consist utility scale solar power plant utilizing single axis tracked PV systems install in two arrays. Solar facilities are low impact in terms of using county resources, and will bring tax benefits to Klamath County. The fee in lieu of taxes shall be $7,000 multiplied by the rated nameplate capacity of the project measured in MWac beginning FY2023/2024.
Recommended Motion: That the Klamath County Board of Commissioners approve the amended 20-year Payment in Lieu of Taxes (PILOT) agreement with Skysol, LLC, and Oregon Limited Liability Company and Klamath County. Fiscal Impact, the project revenue is $388,500 per year and $7,770,000 over the life the agreement to the general fund (non-departmental) in the project’s current capacity.
Background: The Board of Commissioners desire to have a master agreement with Downtown Association as to allow Department Directors to be able to complete the necessary paperwork and be able to participate in the Third Thursday events.
Recommended Motion: Approve the master agreement with Downtown Association. Fiscal Impact: Booth rent (fee set by Downtown Association) to be paid from individual department budget.
Background: Specialty Courts are designed to utilize a targeted team approach in handling certain criminal cases involving specific types of offenders. Klamath County has a long and successful history of using Specialty Courts to address the needs of mental health and drug court clients. The project goal is to provide an opportunity to address the client needs in a court forum in hopes to reduce recidivism. The project period is July 1, 2023 – June 30, 2025.
Recommended Motion: Approve the District Attorney’s Office to apply for the Specialty Court Grants. The Fiscal Impact is zero at this time.
Background: The Klamath County Library Service District applied for a grant provided by the Oregon Department of Human Services on behalf of the Sprague River Library. The Sprague River branch library is located at 32402 Sprague River Hwy, Sprague River, and serves as a community center and post-office annex. The library building doesn’t have central air cooling. We applied and were awarded a grant for $12,730 to replace the gas furnace & swamp cooler and install a new HVAC system. We requested quotes from local contractors:

• Bliss Heating & Air Conditioning + Shaffer Electrical: $13,097
• The Heat-N-Air Man= $12,980
The Heat-N-Air Man submitted the lowest bid.
