In the matter of approving a Resolution Declaring a State of Emergency in Klamath County for the Golden Fire. - Emergency Management

Background: Local and regional emergency and recovery resources have been exhausted as conditions for a fast­ moving fire, Golden Wildfire, that has been prevalent for several days. 86 structures, 43 of which are residences have been destroyed. Additional resources including fire crews, fire equipment and additional fire engines are urgently needed to assist this area to preserve life and property.

Recommended Motion: The Resolution Declaring a State of Emergency in Klamath County was approved and signed in the Work Session Meeting on July 26, 2023. Fiscal Impact is None.

In the matter of accepting the bid from Rocky Mountain Construction, LLC for the 2023 Sprague River Road Overlay project. Jeremy Morris, Public Works

Background:  On June 19, 2023 Public Works issued an Invitation For Bids for 2023 Sprague River Road Overlay project.  On July 11, 2023 the Public Works Department opened bids and received the following responsive bid:

Rocky Mountain Construction, LLC        $1,853,278.00

Public Works requests that the bid be awarded to Rocky Mountain Construction, LLC for $1,853,278.00.  

Recommended Motion:  Board to approve the bid from Rocky Mountain Construction, LLC for the 2023 Sprague River Road Overlay project.  Fiscal impact is none.

In the matter of appointing Cody Redding to the Developmental Disabilities Advisory Board. - BOCC

Background: The Developmental Disabilities Advisory Board has a vacancy and has recommended the above named applicant who is willing, able and eligible to serve a term on the Committee commencing this day and expiring September 30, 2023.

Recommended Motion: Approve and sign the attached Order appointing Cody Redding to the Developmental Disabilities Advisory Board. There is no Fiscal Impact.

Public Hearings

1.

TIME CERTAIN 1:15pm In the matter of holding a public hearing to hear testimony regarding changes to the Solid Waste fee schedule. CDD Solid Waste, Tom Crist/Stephanie Brown

Background:  The purpose of this hearing is to discuss the intent to adopt an adjusted fee schedule for all facilities within the Solid Waste Division. The Klamath County Board of Commissioners may adopt a new fee or increase fees by resolution and shall provide an opportunity for interested persons to comment on those fees. Notice of a Public Hearing was advertised in the Herald & News on July 22, 2023 to hear public comment on August 1, 2023 at 1:15 pm. Only one hearing is required. (TIME CERTAIN: 1:15 PM)

Recommended Motion:  Hold the Public Hearing.  Fiscal Impact: Expenditure of $128.46 for publication from Solid Waste budget. 


1.1.

In the matter of approving and signing a Resolution adopting a new fee schedule for the Solid Waste Division. CDD Solid Waste, Tom Crist/Stephanie Brown

Background:  At the current tipping fee rate Klamath County Solid Waste Division is experiencing a growing disparity between revenues and expenses. The proposed fee increase is an effort to resolve current and future depletion of the Solid Waste budget. The last fee increase was a volume increase to the outlying transfer stations March 1, 2014; the last per ton fee increase March 1, 2009. The anticipated effective date for first 13% increase will begin on September 1, 2023, with an additional 13% increase September 1, 2024, and an additional 13% increase September 1, 2025, followed by a 4% increase effective September 1, 2026 as outlined in Exhibit A. Each year thereafter shall have a 4% increase effective on the 1st day of September.    

Recommended Motion:  Approve and sign the attached Resolution adopting a new fee schedule for the Solid Waste Division effective September 1, 2023, with future increases as outlined in Exhibit A.  Fiscal Impact: Additional revenue anticipated in FY 23/24 $590,431

Agreements

1.

In the matter of approval of Amendment 2 to Agreement 156-21 between the Oregon Department of Environmental Quality (DEQ) and Klamath County. - Jennifer Little, Public Health

Background:  In May of 2021, Klamath County Public Health (KCPH) received board approval to enter into agreement 156-21 with Department of Environmental Quality for the Targeted Airshed Grant Program. During the course of the project, the weatherization component has been lagging behind. Originally, $2500 per household was budgeted, but due to rising costs of labor and materials, this amount does not cover a sufficient portion of projects. This has resulted in a lack of participation in the program or insufficient weatherization work. KCPH has been granted an amendment to increase the allocation for each household to $5000, for a total of 69 homes participating. The project agreement remains effective through November 30, 2025. 

Recommended Motion:  Move to approve amendment 2 to Agreement 156-21 between the Oregon Department of Environmental Quality (DEQ) and Klamath County.  No fiscal impact.  Authorize department head to sign.

In the Matter of approving a Consent to Annexation Agreement with the City of Klamath Falls. - BOCC

Background: The Board of County Commissioners approved a project to expand the existing RV Park at the Klamath County Fairgrounds from 24 full service sites to 48 full service sites.  The City of Klamath Falls has requested the tax lots, listed in exhibit A of the agreement, be annexed into the City to connect to the water and sewer system for the expansion.

Recommended Motion:  Approve the Consent to Annexation Agreement with the City of Klamath Falls and authorize the Chair to sign. There is no fiscal impact.

3.

In the matter of approving and signing Klamath County Domestic Well Financial Assistance Grant Agreements - Natalie Parker, Grant Manager

Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

          STORK, VICKI         $21,714.20

          WOOD, JASON       $39,941.62

Recommended Motion: Approve and sign the Klamath County Domestic Well Financial Assistance Grant agreements with above recipients. Fiscal impact: $61,655.82 expenditure from the Commissioners Miscellaneous Grant Fund.

4.

In the matter of executing the contract between Klamath County and Rocky Mountain Construction, LLC for the 2023 Sprague River Road Overlay project. Jeremy Morris, Public Works

Background:  The Board of County Commissioners awarded the bid for the above referenced project.  Execution of the contract finalizes the award.

Recommended Motion:  Board to approve and sign the contract between Klamath County and Rocky Mountain Construction, LLC for the 2023 Sprague River Road Overlay project.  Fiscal impact is $1,853,278.00 expenditure to the Road Operating Budget.

Other County Business

1.

In the matter of a Deed of Dedication for road and public utilities right-of-way. Jeremy Morris, Public Works

Background:  Per CUP 10-21 provisions, Whitty Midnight Salamander, LLC was required to dedicate 5’ along the property frontage as described in Exhibit A and Exhibit B for public right-of-way for road and utility purposes.  The attached Deed of Dedication satisfies this requirement.

Recommended Motion:  Board to approve and sign the Deed-of-Dedication for road and public utilities right-of-way.  Fiscal impact none.
