In the matter of approving the minutes from the August 1, 2023 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Recommended Motion: Approve the minutes as presented. Fiscal Impact is None.

Bids/Awards/Proposals

1.

In the Matter of accepting the lowest quote for flood damage repair at the motel. Aaron Hartman, Community Corrections

Background: On February 1st, 2023, two pipes (one above the kitchen in the office and one above the shower in room 101) broke due to freeze at our Project Homefront location (5225 Hwy 97 N.,Klamath Falls, OR. 97601). Community Corrections then request quotes for repairs. We attempted to get three (3) quotes, but only received two (2) quotes back. The two (2) quotes are as follows:

LNS Construction: $147,501.85

Triple j Construction: $170,000

Recommended Motion: Accept the quote of $147,501.85 from LNS Construction and allow Aaron Hartman to sign to accept the quote. Fiscal Impact: no fiscal impact at this time.

In the matter of accepting the quote from Mathis Concrete, LLC for the 2023 Shasta Way Driveway Ramp Repairs project. Jeremy Morris, Public Works

Background:  On July 5, 2023 Public Works requested written quotes for the reconstruction of driveway ramp panels on Shasta Way from Madison Street to Patterson Street.  Construction services include excavation, subgrade preparation, concrete construction and traffic control.  Public Works requested quotes from three local contractors and the following quote was received: 

Mathis Concrete, LLC        $49,487.39

Klamath County Public Works requests the quote be awarded to Mathis Construction, LLC.

Recommended Motion:  Board to approve the quote from Mathis Concrete, LLC for the 2023 Shasta Way Driveway Ramp Repairs project.  Fiscal impact is none.

3.

In the matter of accepting the quote from Peterson Cat for One (1) New Caterpillar Motor Grader with Henke Lift Folding V-Plow. Jeremy Morris, Public Works

Background:  Klamath County Public Works would like to utilize Klamath County’s membership in the Sourcewell cooperative purchasing program by purchasing One (1) New Caterpillar Model 150 Motor Grader off of Sourcewell Contract 011723-Cat.  Total cost is $443,000.00.

Recommended Motion:  Board to accept the quote from Peterson Cat for One (1) New Caterpillar Model 150 Motor Grader with Henke Lift Folding V-Plow, authorize Department Head to sign and authorize Public Works to issue a purchase order.  Fiscal Impact is $443,000.00 expenditure from the Road Department Equipment Reserve Budget.

Resolutions

1.

In the matter of declaring a local emergency in Klamath County to deal with the Annular Solar Eclipse. - BOCC

Background: There is an Annular Solar Eclipse expected on October 14, 2023.  Local resources are likely to be exhausted due to a rapid influx of visitors from outside Klamath County and the State within and proximate to the eclipse’s path.  Klamath County hereby deems it necessary to declare a State of Emergency and to seek State assistance for the purpose of providing appropriate available resources.   

Recommended Motion: Approve and sign the attached Resolution declaring a local emergency in Klamath County to deal with the Annular Solar Eclipse. There is no fiscal impact.

8.

Orders

1.

In the matter of executing an order for the imposing of speed restrictions on Booth Road and Vale Road. Jeremy Morris, Public Works

Background:  A speed zone investigation has been conducted in response to multiple complaints from residents living on Booth Road and Vale Road.  After consideration of the 85th percentile speed, functional classification, zoning and received complaints from land owners, Public Works recommends establishing a 45 mph speed zone based on OAR 734-020-0015 (3)(b)(C) speed zone procedures. Estimated cost is $6,000.00 ($3,000.00 for speed study and $3,000.00 to fabricate and install new signs).

Recommended Motion:  Board approve and execute the order for the imposing of speed restrictions on Booth Road and Vale Road.  Fiscal Impact is approximately $6,000.00 expenditure to the Road Operating Budget.

1.

In the Matter of approving Amendment number one (1) to the ENA with Rocky Mountain Construction originally approved May 17th, 2022, to create a DDA for the Foothills Property. Property Sales; Terry Wells

Background: Klamath County, a pollical subdivision of the State of Oregon, issued an RFP for developing County owned property, Map Taxlot 3809-03500-00400. This Amendment number one (1) extends the expiration to the previously approved ENA (Exclusive Negotiating Agreement) for the creation of a DDA (Disposition and Development Agreement) with Rocky Mountain Construction for the development of the said property. 

Recommended Motion:  Approve and sign Amendment number one (1) to the existing Exclusive Negotiating Agreement (ENA) with Rocky Mountain Construction for the development of a Disposition and Development Agreement (DDA) with Klamath County. Fiscal impact: None

3.

In the matter of approving and signing the Klamath County Midland Well Feasibility Study "Water Fund Technical Assistance Project Financing Contract." - Natalie Parker, Grant Manager

Background: During the September 27, 2022 Finance Meeting, permission was granted by the Klamath County Board of County Commissioners to allow Public Works Director, Jeremy Morris, to apply for grant assistance with Business Oregon for three Community Well Feasibility Studies as part of the ongoing drought efforts. The three community well studies are: Midland, Beaver Marsh, and Chemult.

Recommended Motion: Approve and authorize Public Works Director to sign the Klamath County Midland Community Well Feasibility Study “Water Fund Technical Assistance Project Financing Contract” grant agreement with Oregon Business Development Department. Fiscal impact: $20,000.00 revenue to the Commissioners Miscellaneous Grant Fund – Klamath County Domestic Well Grant Fund.

In the matter of approving and signing Klamath County Domestic Well Financial Assistance Grant Agreements - Natalie Parker, Grant Manager

Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants: DODGE, CHARLES & LINDA $40,000.00; WEDAM, ALBERT $31,040.74.

Recommended Motion: Approve and sign the Klamath County Domestic Well Financial Assistance Grant agreements with above recipients. Fiscal impact: $31,040.74 expenditure from the Commissioners Miscellaneous Grant Fund.

5.

In the matter of an Agreement between Klamath County Public Works and the City of Klamath Falls for Chip Sealing Services. Jeremy Morris, Public Works

Background:  The City of Klamath Falls has requested assistance with street maintenance.  This agreement will allow Klamath County to perform chip seals to the City of Klamath Falls and be reimbursed per the attached specifications during the summer of 2023.  

Recommended Motion:  Board to approve and execute the Agreement between Klamath County Public Works and the City of Klamath Falls.  No Fiscal Impact, however revenues and expenditures will be increased up to $250,000.00.

6.

In the matter of executing the contract between Klamath County and Mathis Concrete, LLC for the 2023 Shasta Way Driveway Ramp Repairs project. Jeremy Morris, Public Works

Background:  This project is for the reconstruction of driveway ramp panels on Shasta Way from Madison Street to Patterson Street.  Construction services include excavation, subgrade preparation, concrete construction and traffic control.

Recommended Motion:  Board to approve and sign the contract between Klamath County and Mathis Concrete, LLC for the 2023 Shasta Way Driveway Ramp Repairs project.  Fiscal impact is $49,487.39 expenditure to the Road Operating Budget.

10.

Grants

1.

In the Matter of approving the District Attorney’s Office to apply for the Victims of Crime Act (VOCA) Grant 2023-2025, and authorize Finance Director Vickie Noel to sign the Certificate of Non-Supplanting, Melina Johnson, DA

Background:  Congress passed the Victims of Crime Act on October 12, 1984.  This Act serves as central source federal funding to support direct services to victims of crime.  The District Attorney’s Office has applied for and received funding over the last 37 years to support victims’ services. Currently state and federal funding pays for three trained victim service advocates who provide direct services to victims of crime.  Further, Oregon law grants crime victim’s authority to consult for violation of constitutional rights. The project period for this grant is 10/1/2023-9/30/25.

Recommended Motion:  Approve the District Attorney’s Office to apply for the VOCA grant 2023-2025, and authorize Finance Director Vickie Noel to sign the Certificate of Non-Supplanting. The fiscal impact is $386,176 in the District Attorney Special Revenue Budget.

Licenses

1.

In the matter of approving a recommendation for a renewal liquor license for Castel’s Southside, Crater Lake Zip Line, Cinders Café, Worden Truck Stop, Crater Lake Junction Travel Center, Black Bear Diner, Squaw Flat Store, Crescent Shell, Manley’s Tavern, Midland Family Market, Murphy’s Market, Whistler’s Trading Post, Eastside Liquor, Odell Lake Lodge & Resort and Stagecoach Pizza. - BOCC

Background: The Oregon Liquor Control Commission (OLCC) verifies that each tavern/store has met the necessary conditions to sell liquor.  The County’s position is a recommendation only and the OLCC may take the recommendation into consideration before granting or refusing the license.

Recommended Motion: Note for the Record. Fiscal Impact: Revenue of $10.00 for each renewal license to the General Fund-Commissioners.
