In the matter of approving the minutes from the August 8, 2023 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Recommended Motion: Approve the minutes as presented. Fiscal Impact is None.

Orders

1.

In the matter of Klamath County Transient Room Tax second quarter distribution ending June 30th, 2023. Kayla Wessel/ Tax

Background:  In accordance with Klamath County Code Chapter 603; any person, firm, social club, etc., who exercises occupancy for thirty days or less for dwelling, lodging, or sleeping purposes from any hotel, motel, etc. from an operator; shall collect the tax imposed which constitutes a debt owed by the operator to the County.  The amount collected for the second quarter came to $971,424.62 and shall be distributed accordingly by the tax revenue sharing formula to the Participants.

Recommended Motion:  Approve and execute the attached Order so the Tax Administrator can distribute accordingly by the tax revenue sharing formula $971,424.62 to the Participants of the Transient Room Tax set by Klamath County Code 603.610.  Fiscal impact being revenue received and distributed in the amount of $971,424.62. Expenditure of $971,424.62 to the Transient Room Tax Fund.

In the matter of appointing Jennifer Cole, Joe Spendolini and Scott Siracusa to the Klamath County Library Advisory Board. - BOCC

Background: The Klamath County Library Advisory Board has multiple vacancies. Nine people applied, interviews were conducted and the Board of Commissioners have agreed to appoint Jennifer Cole, Joe Spendolini and Scott Siracusa to three of the vacancies commencing this day and expiring June 30, 2026.

Recommended Motion: Approve and sign the attached Order appointing Jennifer Cole, Joe Spendolini and Scott Siracusa to the Klamath County Library Advisory Board. There is no Fiscal Impact.

Agreements

1.

In the matter of approving a Maintenance Agreement between Canon Solutions America and Klamath County Public Health. - Jennifer Little, Public Health

Background:  On September 17, 2019, Klamath County Public Health (KCPH) received board approval to enter into a 48-month lease agreement with Canon Solutions America for an imageRunner Advance C5560i III all-in-one machine. Per the terms of that agreement, Klamath County Public Health would like to move forward with the option to purchase this equipment for $1 at the conclusion of lease term and enter into a 12-month maintenance agreement for continued service coverage from Canon.  The cost of the maintenance contract will be on a per copy basis with a cost of $.007935 cents per black and white copy and $.046 cents per color copy. 

Recommended Motion:  Move to approve a Maintenance Agreement between Canon Solutions America and Klamath County Public Health. Fiscal Impact is estimated monthly cost of $205.00 based on historic monthly average of 6,200 black and white copies and 3,400 color copies made, or $2,460 for the agreement period.  Authorize department head to sign.


2.

In the matter of approval of Amendment 2 to the Intergovernmental Agreement between South Central Oregon Economic Development District (SCOEDD) and Klamath County Public Health. - Jennifer Little, Public Health

Background:  In July 2021 Klamath County Public Health (KCPH) entered into an intergovernmental agreement with SCOEDD to conduct woodstove changeouts and  weatherization projects for the Targeted Airshed Grant. In November 2021 amendment 1 was signed to increase allocation for each woodstove and reduce the total number of projects. Throughout the course of the project, the weatherization component has been lagging behind. Originally, $2500 per household was budgeted, but due to rising costs of labor and materials, this amount does not cover a sufficient portion of projects. This has resulted in a lack of participation in the program or insufficient weatherization work. KCPH has been granted an amendment by DEQ to increase the allocation for each household to $5000, for a total of 69 homes participating. The project agreement remains effective through November 30, 2025. 

  


Recommended Motion:  Move to approve Amendment 2 to the Intergovernmental Agreement between South Central Oregon Economic Development District (SCOEDD) and Klamath County Public Health. No fiscal impact.  Authorize department head to sign.


3.

In the Matter of approving the Klamath County Sheriff to modify the current agreement with the United States Department of Interior, Bureau of Land Management (BLM) to acknowledge potential increased revenues. - Chris Kaber, Sheriff

Background: The agreement number 140L4319P0121 P00008 will be in effect from October 1, 2023 through September 30, 2024.  This modification is reallocating unused funds from option period October 1, 2021 through September 30, 2022 to option year 4, October 1, 2023 through September 30, 2024, increasing potential revenues $10,000. 

Recommended Motion:  Approve the Sheriff to sign agreement 140L4319P0121 Modification P00008 to acknowledge the reallocation of $10,000 in unused revenues from October 1, 2021 thru September 30, 2022 to increase potential revenues $10,000 for October 1, 2023 thru September 30, 2024 for law enforcement services provided. Fiscal Impact: Increase potential revenues in the amount of $10,000 based on hours of service provided.

In the matter of approving Amendment #1 to the HIGH CALIBER SPIRITS, LLC “Infrastructure” Grant Agreement. - Natalie Parker, Grant Manager

Background: High Caliber Spirits LLC was awarded a contract for a Tourism Competitive Grant on October 28, 2022. The contract completion date is August 15, 2023. Due to unforeseen circumstances,High Caliber Spirits LLC has requested an extension to complete the Tourism grant. The attached amendment extends the contract for 6 months.

Recommended Motion: Motion to approve Amendment #1 to the contract between Klamath County and High Caliber Spirits, LLC. Fiscal Impact: There is no fiscal impact.

In the matter of approving Amendment #1 to the HIGH CALIBER SPIRITS, LLC “Marketing” Grant Agreement. - Natalie Parker, Grant Manager

Background: High Caliber Spirits LLC was awarded a contract for a Tourism Competitive Grant on October 28, 2022. The contract completion date is August 15, 2023. Due to unforeseen circumstances High Caliber Spirits LLC has requested an extension to complete the Economic Development grant. The attached amendment extends the contract for 6 months.

Recommended Motion: Motion to approve Amendment #1 to the contract between Klamath County and High Caliber Spirits, LLC. Fiscal Impact: There is no fiscal impact.

In the matter of approving and signing cooperative agreement number 23-7341-6977-RA with US Department of Agriculture for USDA APHIS Wildlife Services. - Natalie Parker, Grant Manager

Background: The purpose of the Wolf Depredation Compensation and Financial Assistance Agreement is to assist the County in supporting the implementation of non-lethal wolf damage management techniques and strategies by livestock producers in areas where wolf depredation of livestock is on-going and to provide compensation for injury or death to livestock resulting from wolf depredation.

Recommended Motion: Approve and authorize the chair to sign the US Department of Agriculture for USDA APHIS Wildlife Services. Fiscal impact of $17,000.00 expenditure from the Wolf Depredation Grant.

8.

In the matter of approving and signing Klamath County Domestic Well Financial Assistance Grant Agreements - Natalie Parker, Grant Manager

Background: In 2021 Klamath County experienced a severe and continuing drought. On March 31, 2021 Governor Brown signed Executive order 21-07 declaring a State of Drought Emergency in Klamath County. That Order initiated several opportunities to assist Klamath County residents experiencing domestic well challenges resulting from the drought. The Domestic Well Grant is to provide financial assistance to the owners of domestic wells located within Klamath County who experienced challenges with their domestic well due to the 2021 drought. The following grant recipients have satisfied all grant submissions and the agreements are complete and signed by the applicants.

EYTCHISON, ART & EDITH        $21,498.15

MERKLEY, MICHAEL & MARIE  $11,174.58

WEDAM, ALBERT                       $31,040.74

Recommended Motion: Approve and sign the Klamath County Domestic Well Financial Assistance Grant agreements with above recipients. Fiscal impact: $63,713.47 expenditure from the Commissioners Miscellaneous Grant Fund.

8.

Ordinances

1.

In the matter of signing an Ordinance to render the prior approval of CLUP 2-23 into writing. - Erik Nobel, Planning

Background:  On July 25, 2023, the Klamath County Planning Commission held a public hearing and heard a Comprehensive Plan request to amend Article 45.5 (Property Line Adjustments) and the creation of a new article 45.7 (Single Parcel Unification).  The Board of County Commissioners after listening to the Planning Commission hearing, deliberated and unanimously approved the requested Comprehensive Plan and Zone Change, based on the findings and recommendation of the Planning Commission.  To transition from the current process to the new procedure within the proposed ordinance, the effective date of this ordinance shall be November 1, 2023.   

Recommended Motion:   Approve to sign the Ordinance rendering the prior approved decision into writing. There is no fiscal impact to Klamath County.
